AMENDMENT NO. 1
CONTRACT FOR PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "City ", and ALAN PLUMMER ASSOCIATES. INC.
hereinafter called "Engineer", agree to the following amendments to the Contract for Professional Services for

Meet with TCEQ Water Quality Planning Division and with TCEQ Pretreatment Section to Discuss Copper
Standards Issues.
From the original contract, Exhibit "A ", Activity IV, Permit and Regulatory Assistance — 2011 through 2013, is
amended to include additional Tasks for Continued Assistance with Permitting and Regulatory Issues at the
City's Wastewater Treatment Plants for 2011 — 2012.
From the original contract, Exhibit "A ", Project Fees and Budgets is amended as specified in Exhibit "B"
Summary of Fees.
All other terms and conditions of the May 31, 2011 contract between the City and Consultant, and of any
amendments to that contract, which are not specifically addressed herein shall remain in full force and effect.

AMENDMENT NO. 1 TO A PROJECT FOR
WASTEWATER TREATMENT PLANTS PERMIT & REGULATORY ASSISTANCE —
INDUSTRIAL PRETREATMENT PROGRAM TECHNICALLY BASED LOCAL
LIMITS ASSESSMENT
The Scope of Services outlined below is an amendment to an Agreement (AGREEMENT) between the
City of Corpus Christi (CITY) and Alan Plummer Associates, Inc., (CONSULTANT) executed on .Tune 2,
2011 (CITY Project Number El 1056). CONSULTANT will continue providing services associated with
the CITY's industrial pretreatment program (Program) as required in the City's Oso Wastewater
Treatment Facility (Oso WWTF); Texas Pollutant Discharge Elimination System (TPDES) Permit
Number WQ0010401 -004 and Activities I and IT that are described in the original AGREEMENT.
This amendment to the AGREEMENT enables the CONSULTANT to begin work on the
redevelopment of technically based _local limits (TBLLs) for copper as described in the
AGREEMENT under Activity III - Redevelop Technically Based Local Limits (see Page 5 of 12 of Exhibit
A in the AGREEMENT). Tasks to determine or support applicable criteria for developing an appropriate
TBLL for copper are added by this amendment. In addition this amendment will Provide continued
support for various regulatory and permitting issues, as described under Activity IV- Permit and
Regulatory Assistance for Calendar Years 2011 -2013 (see Page 10 of 12 of Exhibit 'A in the
AGREEMENT).
At the completion of the work described in this amendment, the CONSULTANT will provide a
scope and budget for a second amendment to the AGREEMENT in order to complete all work
associated with redevelopment of TBLLs for the CITY The scope and budget for the second
amendment cannot be determined at this time because it will be affected by the results of the work under
this first amendment.

Under the AGREEMENT, the CONSULTANT has completed Activity I in the AGREEMENT related to
an assessment of the City's TBLLs. The results of Activity I demonstrated that additional studies are
necessary for developing a TBLL for copper that meets the objectives of the Program. The potential need
for these services was addressed in the AGREEMENT. However, as noted in the scope of the
AGREEMENT, it was necessary to complete Activity I in order to identify the extent of services that are
needed.
The renewed TPDES permit for the Oso WWTF was issued on April 29, 2011. Regulatory schedules
associated with the Program assessments and modifications are specified in the new permit with which
the CITY must comply. It was the intent of the AGREEMENT to address the requirements of this
schedule. A recap of the status of these requirements follows:
• The permit requires the CITY to submit either a written certification that a technical reassessment
has been performed and that the evaluation demonstrates that the existing technically based local
limits (TBLLs) achieve the objectives of the pretreatment program, or a written notification that a
technical redevelopment of the current TBLLs will be conducted, The required documentation
was due to the Texas Commission on Environmental Quality (TCEQ) no later than 60 days after
issuance of the Oso WWTF TPDES permit. The required documentation was submitted on
June 28, 2011, as required. The documentation indicated that recertification of existing
TBLLs for all parameters, with the exception of copper, is appropriate. It was found that
copper concentrations in the effluent from the Oso WWTF and the Allison WWTF exceed
the surface water quality standards for the receiving water bodies for these facilities. The
initial_study determined _that _for copper, additional_ information is necessary. The CITY has
determined that the additional documentation regarding copper should be completed under
Activity III, which originally included proposed scope related to redevelopment of TBLLs.
It should be noted that once the additional tasks identified in this scope are completed, it will still
be necessary to incorporate changes to the Program with respect to implementation of a copper
TBLL. If the CITY desires the CONSULTANT to provide additional services related to
completing the modification to the Program, the CONSULTANT will provide a scope for an
additional amendment of the AGREEMENT at that time.
• The CITY must modify the Program to comply with the amendments to Title 40 Code of Federal
Regulations Part 403 (40 CFR Part 403) regulations (Streamlining Provisions) that were adopted

October 14, 2005. Proposed modifications associated with the Streamlining Provisions are
required to be submitted to the Texas Commission on Environmental Quality (TCEQ) within 12
months of the issuance of the renewed Oso WWTF TPDES permit. In accordance with Activity
II previously approved by the CITY the CONSULTANT is addressin2 the re uirements of
this item.
• If it is determined that TBLLs must be technically redeveloped, the CITY must irnmediately
undertake the process of redevelopment. Modifications to the pretreatment program associated
with the redeveloped TBLLs, if appropriate, are required to he submitted to TCEQ within 12
Months of the issue date of the renewed Oso WWTF TPDES permit As indicated above, the
recertification documentation indicated that additional information is needed for copper.
For purposes of this amendment of the AGREEMENT, the fees proposed for Activity III are approved as
part of the current amendment. All conditions of the AGREEMENT and the CONSULTANT'S Schedule
of Fees (Exhibit B of the AGREEMENT) are applicable to this amendment. A scope for the amended
Activity III follows.
SCOPE OF SERVICES
CONSULTANT will assist the CITY with the development of TBLL(s) for copper. The additional tasks
for the amended scope of services under Activity III are as follows:
Task III -8 Assist with Implementation of Clean Techniques for Copper Monitoring
Task III -9 Meet with TCEQ Water Quality Planning Division and with TCEQ Pretreatment
Section to Discuss Copper Standards Issues
In addition, additional tasks under Activity IV are as follows:

These tasks are described below.
Task III -8. Assist with Implementation of Clean Techniques for Copper Monitoring
The CONSULTANT will assist the City with development of procedures for conducting clean techniques
for monitoring copper, Clean techniques for the collection and analyses of effluent samples from the Oso
and Allison WWTFs will be developed, The objectives of implementing clean techniques are to prevent
contamination of samples, ensure that copper concentrations observed in analytical testing results
accurately reflect actual concentrations in the effluent, and to determine treatment plant performance for
removal of copper in the wastewaters. The CONSULTANT will provide support in the development of
procedures for copper sampling and testing, as well as review of the analytical reports.
The CONSULTANT will prepare a draft procedure for clean sampling of the effluent at the Oso and
Allison WWTFs. The CITY will provide comments to the draft procedure. The CONSULTANT will
finalize the procedure based on comments from the CITY. The CONSULTANT will assist the CITY as
necessary through conference calls to discuss the procedures.
Upon receipt of analytical results for the monitoring conducted at the two plants, the CONSULTANT will
assist with the review of the results. The CONSULTANT and the CITY will discuss assessment of the
laboratory report and the results by conference call.
Task III -9. Meet with TCEQ Water Quality Planning Division and with TCEQ Pretreatment
Section to Discuss Copper Standards Issues
The CONSULTANT will coordinate with the CITY and the TCEQ to hold two meetings at the TCEQ's
offices in Austin, Texas. These meetings are critical to determining the amount of work that will be
necessary to complete.the TBLLs project. The scope associated with each meeting is described in the
following subtasks.
Subtask III =9.1: Meet with the Water Quality Permittinz Team
The CITY and CONSULTANT will meet with members of the Water Quality Permitting Team to discuss
the appropriateness of the designation of the receiving waters for Outfall 0002 for the Allison WWTP and
Outfall 001 for the Oso WWTP as "Oyster Waters." This designation results in very restrictive copper
standards for the receiving streams and precludes the use of a water- effect ratio study to modify the water
quality standard for copper. The CONSULTANT will coordinate to establish an acceptable date and time

for the meeting. In addition, the CONSULTANT will prepare necessary maps or other documentation in
preparation for the meeting.
After the meeting, the CONSULTANT will prepare a summary of the meeting and provide the summary
to the CITY. The summary will include recommendations for further actions in the project. Such actions
will require a further amendment of the AGREEMENT. The scope of such an amendment will be based
on the results of the meeting with the TCEQ.
Subtask III -9.2: Meet with the Pretreatment Team
Once the CITY has considered the recommendations prepared as a result of the first meeting with the
TCEQ, the CONSULTANT will coordinate with the Pretreatment Team of the TCEQ to establish an
acceptable date and time for the CITY, CONSULTANT, and Pretreatment Team to meet. The purpose of
this meeting will be to discuss options and schedules for completing the recalculation of local limits for
copper for the Oso and AIlison WWTPs. The timing for this meeting will be dependent on the outcome
of the first meeting with the TCEQ.
After the second meeting, the CONSULTANT will prepare a summary of the meeting and provide the
summary to the CITY. The summary will include a schedule for completing the TELL project, as
determined in the meeting. It is possible that the outcome of the second meeting will require a further
amendment of the AGREEMENT. At this time, however, it is believed that the second amendment of the
AGREEMENT, as addressed in Subtask III -9.1, will be sufficient for the project.
Task N -1. Continued Assistance with Permitting and Regulatory Issues at the City's Wastewater
Treatment Plants for 2011 -2012
On October 6, 2011, the CITY received a draft permit for the Greenwood Water Reclamation Plant from
the TCEQ. The draft permit included a whole effluent toxicity (WET) limit. The CITY has requested the
assistance of the CONSULTANT in responding to this draft permit. In addition, other permitting or
regulatory issues related to the CITY's facilities may develop from time to time. It cannot be determined
specifically what will be required in this response, but the following potential services are possible:
• Meetings and telephone conversations with TCEQ staff or staff of Region 6 of the Environmental
Protection Agency (EPA)
• Meetings and telephone conversations with the CITY's attorney or wastewater staff

CONSULTANT will provide services under this task as requested by the CITY.

Following are provided proposed fees for Amendment No. 1, as described above. Included are proposed
labor, by task, and expenses, for the amendment. With approval of this amendment to the
AGREEMENT, the CONSULTANT will be authorized to proceed with Activity III, as required.

The fee for the original AGREEMENT was $74,200. The total fee for the amended AGREEMENT,
therefore, is $122,500.00 (Original plus Amendment No. 1.} Billing for these activities will be on a
time and material basis, in accordance with provisions of the original Agreement.

ADDITIONAL SERVICES
ADDITIONAL SERVICES are those that are not currently anticipated to be a part of the project but
which could become necessary or desired at some time during the project or the scope of the services
cannot be adequately defined at this time. CONSULTANT will perform additional services only as
authorized to do so by CLIENT. IF CLIENT requests ADDITIONAL SERVICES, CONSULTANT will
prepare a specific scope and budget for the services requested for review and approval of CLIENT prior
to initiating the services. Following is a list of some of the ADDITIONAL SERVICES that might be
needed or desired.
• Support for additional sampling events in connection with the Copper WER.
• Field reconnaissance beyond the events described by CONSULTANT or assistance during
sampling.
• Meeting in Corpus Christi or at the Texas Commission on Environmental Quality beyond those
identified inl BASIC SERVICES.
There may be other potential ADDITIONAL SERVICES, Should CLIENT desire CONSULTANT to
perform ADDITIONAL SERVICES, this contract will be amended to accommodate the additional work.
