■ EXHIBIT "A ", PART 1. SCOPE OF SERVICES, SECTION A. BASIC SERVICES ITEM NO. 1
PRELIMINARY PHASE shall be modified to include additional Preliminary Phase Services as
shown on the attached Amendment No. 4 Exhibit "A ".
■ EXHIBIT "A ", PART 3. FEES shall be modified as shown on the attached Amendment No. 4 Exhibit "B"
for a revised fee not to exceed 37 700.00 ThiLl -Seven Thousand Seven Hundred Dollars and Zero
Cents), for a total restated fee not to exceed $1,254,276.70 (One Million Two Hundred Fifty -Four
Thousand Two Hundred Seventy-Six Dollars and Seventy Cents).
All other terms and conditions of the June 19, 2009 contract and amendments between the City and
Consultant will remain in full force and effect.

RE: DAYFRONT DEVELOPMENT PLAN, PHASE 3 (CITY PROJECT NO. 6511)
AMENDMENT NO.4 .
Dean Mr, Anaya:
In a recent meeting, you asked for additional information in'support of our request for
Amendment No. 4 as outlined in our letter of September 6'2011.
Amendment No..3 to our contract.. (dated October 12, 2010), included a preliminary
schematic layout and estimate of probable cost for an option that would provide for a two -
. lane. roadway along Shoreline and a direct connection from Ocean Drive to Water Street.
This, alignment.followed the existing R.O.W. along Water Street and required R.O.W. from
the southwest corner of the church property. The, alignment also included a roundabout at
Buford Street and the two -lane Shoreline alignment pushed to the east away from the
church.. A traffic study of this option was also included. These .items were'.delivered in
early December 2010.
Subsequently, HDR provided exhibits and alignment options as follows:
• (1) The City provided three Amendment 3 alignment variations, 'which were .there
converted and formatted to match the presentation style. previously agreed to
between City staff and HDR.
•. .(2) Revised Amendment 3. to provide dedicated left -turn bays at Buford Street.
• (3) Revised Amendment 3 to add a 5 -leg roundabout at William Street:
+ (4) Revised Amendment 3 to reverse the William Street flow between northbound
and southbound Shoreline Boulevard utilizing. as much existing pavement as
possible.
(5) Revised Amendment 3 to realign Water Street and `avoid any impacts to" the
Methodist Church parking lot. This, in turn, impacted the Dykema Architects
building. =
(6) Revised Amendment 3 by shifting traffic from Shoreline .Boulevard to Water
Street on a new alignment between Furman Avenue and Park Avenue. AMEND. No. 4
• (7) Recreated the original design from the Engineering Letter Report on the updated EXHIBIT "A"

FILING REQUIREMENTS

DEFINITIONS
a. `Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi, Texas.
b. "Economic benefit'. An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
C. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self-employed
person, partnership, corporation, joint stock company, joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non -profit organizations.
"Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
Judges of the City of Corpus Christi, Texas.
f. "Ownership Interest." Legal or equitable interest, whether actually or constructively held,
in a firm, including when such interest is held through an agent, trust, estate, or holding
entity. "Constructively held" refers to holdings or control established through voting trusts,
