hereinafter called "CONSULTANT ", agree to the following amendments to the Contract for
Professional Services for Ocean Drive /Elizabeth Paving Assessment Project No. E11088 ,
as authorized by
Original Contract I Dec. 8, 2011 Emerg Declaration $89,496.00
■ In the original contract, Section II. SCOPE OF SERVICES shall be modified by the addition
of the following scope as shown on the attached Exhibit "A -1" Task List.
Basic Services
1. Design Roadway Improvements to Ocean Drive, including full depth $ 10,915
rehabilitation and curb and gutter replacement for a section of the
northbound pavement between Del Mar Blvd. and Cole Dr. not to exceed
150' in length.
2. Design Roadway Improvements to Ocean Drive, including full depth $ 12,672
rehabilitation and curb and gutter replacement for a section of the
northbound pavement between Cole Dr. and Ayers St. not to exceed 200' in
length.
3. Additional Meetings, Coordination, Site Visits, and Communication. $ 14,248
Additional Services
1. Provide supplemental topographic survey to support roadway repair design $ 4,357
2. Provide public outreach services including prepare presentation for City $ 3,886
Council and prepare exhibit of all findings and issues between Buford Dr.
and Del Mar Blvd.
■ In the original contract, Section Ill. FEES AUTHORIZED shall be modified as shown on the
attached Exhibit "A" for a total fee not to exceed $46,078.00 (in figures) Forty-Six Thousand
Seventy-Eight Dollars and Zero Cents (in words), for a total restated fee not to exceed
$135,574.00 (in figures), One Hundred Thirty-Five Thousand Five - Hundred Seventy-Four
Dollars and Zero Cents (in words).
All other terms and conditions of the December 8, 2011 contract between the City and
Consultant will remain in full force and effect.

Dear Mr. Biles, .
In accordance with previous discussions with City staff regarding the aforementioned project, Freese
and Nichols, Inc. is pleased to provide our professional services contract amendment.
Our proposed contract amendment for basic services includes the design of roadway improvements
including full depth rehabilitation and curb and gutter replacement for a section of northbound
pavement between Del Mar Boulevard and Cole Drive and a northbound pavement section between
Cole Drive and Ayers Street. Additional coordination, site visits and communication is also included in
this activity. Our proposed cost for this service is $37,835.00.
Our proposed amendment also includes Additional Services such as supplemental topographic surveys
required to support roadway design along with public outreach services. Our proposed cost for this
service is $8,243.00
Our overall proposed fee for these additional task items is $46,078.00.

TASK LIST
Basic Services:
1) Develop construction drawings in English units in 22" x 34" sheets, to include the
following for two roadway improvement locations on Ocean Drive (as required
for this project):
• Paving Plans
• Paving Crass - Sections and Details
• Pavement Marking (Striping) Plan
• Traffic Control Plan
2) Prepare opinion of probable construction costs including contingency amounts.
3) Provide Quality Control /Quality Assurance (QC/QA) interim review and prepare
submittal for City's review depicting pre -final development of the contract drawings
and specifications.
4) Address comments received from the City for the pre -final submittal.
5) Provide Quality Control/Quality Assurance (QC/QA) final review and submit
one (1) reproducible hard copy of the final contract drawings and specifications
to the City for bidding process.
5) Update the opinion of probable construction costs.
7) Attend additional meetings, coordinate services and interdepartmental
communication, attend site visits, and respond to additional communication and
review submittals or respond to RFI's or CMC's during construction.
Additional Services:
1) Provide Topographic and Utility Survey:
• Provide topographic survey to design roadway improvements
• Provide Subsurface Utility Video Inspection
2) Provide public outreach support to City Engineer

DEFINITIONS

a. "Board member." A member of any board, commission, or committee appointed by the City
Council of the City of Corpus Christi, Texas.
b. "Economic benefit ". An action that is likely to affect an economic interest if it is likely to have an
effect on that interest that is distinguishable from its effect on members of the public in general or a
substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part-
time basis, but not as an independent contractor.
d. "firm." Any entity operated for economic gain, whether professional, industrial or commercial, and
whether established to produce or deal with a product or service, including but not limited to, entities
operated in the form of sole proprietorship, as self-employed person, partnership, corporation, joint
stock company, joint venture, receivership or trust, and entities which for purposes of taxation are
treated as non - profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City Manager,
Assistant City Managers, Department and Division Heads, and Municipal Court Judges of the City of
