TRAFFIC ANALYSIS shall be modified to include additional Traffic Studies Services as shown on
the attached Amendment No. 5 Exhibit "A ".
• EXHIBIT "A ", PART 3. FEES shall be modified as shown on the attached Amendment No. 5 Exhibit "B"
for a revised fee not to exceed $5,500.00 Five Thousand Five Hundred Dollars and Zero Cents , for a
total restated fee not to exceed $11,269,7761MOne Million Two Hundred Fi -Nine Thousand Seven
Hundred Seventy -Six Dollars and „Seventy Cents)
All other terms and conditions of the June 19, 2009 contract and amendments between the City and
Consultant will remain in full force and effect.

AMENDMENT NO.. 5, ADDITIONAL TRAFFIC STUDIES
Dear Mr. Biles;
In our meeting on January. 12, the Hargreaves. group presented alternate roadway configurations to
the proposed four-lane facility that was most recently presented to City Council. The discussion .
centered on their`Option 4; Separated Parking Lane along the Park. 'This configuration envisions
utilizing the existing southbound roadway for a bike lane, two southbound travel lanes, and one
northbound travel lane. A .second, l I' wide, northbound. travel lane .would be built separated
from the existing roadway by a median and would have diagonal parking. Option 4A is. the same
as Option 4 with the addition of bike traffic on the separated roadway and the lane width
increased to 13.'. The . City's Unified Development Code requires parking lots that have one way
Aisles {lanes) in excess of 150' iii length be 17' wide.
You have requested that HDR perform a traffic analysis of Option 4A to determine capacity and
levels of service HDR will perform this analysis using the 17' lane width. and provide a letter
report summarizing the findings..
We trust that this information is . sufficient for you, to approve our request for approval of
Amendment No. 5 in the amount of $5,500:00.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi, Texas.
b. "Economic benefit ". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
"Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self - employed
person, partnership, corporation, joint stock company, joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non -profit organizations.
"Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
Judges of the City of Corpus Christi, Texas.
f. "Ownership Interest." Legal or equitable interest, whether actually or constructively held,
in a firm, including when such interest is held through an agent, trust, estate, or holding
entity. "Constructively held" refers to holdings or control established through voting trusts,
proxies, or special terms of venture or partnership agreements."
g. "Consultant." Any person or firm, such as engineers and architects, hired by the City of
Corpus Christi for the purpose of professional consultation and recommendation.
