Before me, the undersigned authority, on this day personally appeared Ronald L. Olson, City Manager
of the City of Corpus Christi, who, after being by me duly sworn, under oath states that the City of
Corpus Christi, a Texas home rule municipal corporation, is the owner of record of that certain tract or
parcel of land lying and being situated in Nueces County, Texas, and being more particularly described
as follows:
See the deeds attached and incorporated as Exhibit A.
The undersigned further states that from the year 1976 to the year 20o8 there was operated on the
aforesaid tract of land a Municipal Solid Waste Disposal Site. Specifically, such operation was
conducted on that portion of the aforesaid tract described as follows:
See metes and bounds property description and a map of the property attached and
incorporated as Exhibit B.
Further, the City of Corpus Christi, Texas, was the operator of such Municipal Solid Waste Disposal
Site.
Notice is hereby provided to any future owner or user of the site to consult with the Texas Commission
on Environmental Quality or successor agency prior to planning or initiating any activity involving the
disturbance of the landfill cover or monitoring system.
This Affidavit to the Public supersedes the Affidavit to the Public filed for record under Document No.
200 90336oi on August 18, 2oo9, Deed Records of Nueces County, Texas.

reasonable rights of ingress and egress to explore, drill and produce said oil,
gas and minerals; provided, however such rights shall be subject to the right of
Grantee to reasonably designate those locations only which Will permi such
e7.plDration, dril and production without unreaso interference or obstructions
of the proper use of said land for sanitary land fill purposes_ Any such lease or .
contract hereafter made for the exploration and development of said land for oil,
gas and other minerals shall provide that Lessee shall +ra�J Grantee, its
employees, servants, agents, contractors, invitees and licensees from any and all
lawsuits, demands, liabilities, losses or claims for damages or personal injuries
which may arise from any negligence or other actionable act or Omission on the
Part of Grantor's lessees as a result of operations conducted under any such

It is also understood that this property being conveyed to Grantee will be
used for the expansion of the Elliott Sanitary Landfill, and in this connection
Grantee agrees, at its cost, to erect a new fence and gate along the new coon
