TEMPORARY DRAINAGE EASEMENT

§ KNOW ALL BY THESE PRESENTS:
COUNTY OF NUECES §
THAT Vojo Ventures, LLC, a Limited Liability Company ( "Developer"), whose address is
6838 Greenwood Drive, Corpus Christi, Texas 78415, County of Nueces, State of
Texas, for and in consideration of the sum of One and no /100 Dollar ($1.00) to it in hand
paid by the City of Corpus Christi, Texas, a, Texas Home -Rule Municipal Corporation,
duly incorporated under and by virtue of the laws of the State of Texas ( "City "), of 1201
Leopard Street, Corpus Christi, Texas 78401, County of Nueces, State of Texas, the
receipt of which is acknowledged, has granted, sold and conveyed, and by these
presents does grant, sell and convey to the City of Corpus Christi, Texas, its
successors, legal representatives, permitted assigns and franchisees, the free and
uninterrupted use, liberty, privilege, and easement, of going in, on, over, under, and
along a certain tract of land situated in Nueces County, Texas and being described as
follows:
See the Metes and Bounds property description for a temporary drainage easement
attached and incorporated as "Exhibit A."
See the map showing the location of the temporary drainage easement attached and
incorporated as "Exhibit B ".
The Developer also grants and conveys to the City the rights of free ingress, egress,
and regress to and for the City of Corpus Christi, Texas, all for the purpose of owning
and keeping temporary drainage facilities and for the purposes of maintaining, servicing,
repairing and inspecting said drainage facilities under, on, and along said tract.
The Developer shall construct a temporary drainage channel from the existing
underground system in accordance with plans and specifications provided to and
approved by the City's Director of Engineering Services, or designee (Director). When
the surrounding property is platted, permanent underground storm drainage
improvements shall be constructed by the Developer in accordance with the Unified
Development Code.
Until the permanent underground storm drainage improvements are constructed in this
temporary easement, as required of the Developer in future platting, Developer shall
maintain said temporary drainage facility to insure it provides offsite drainage to the

existing City drainage ditch. Developer shall maintain and repair said temporary
drainage facility within 30 days of the Director's written notice of the type of
maintenance or repairs needed. If Developer does not timely complete maintenance or
repairs, City may provide the needed maintenance or repairs and bill Developer for the
City's expense which the Developer covenants to pay within 30 days after Director's
invoice is received. Developer is deemed to receive the invoice 3 days after it is mailed
to Developer at the address above.
TO HAVE AND TO HOLD, all and singular, the rights and privileges as describe above
to the City of Corpus Christi, Texas, its successors, legal representatives, permitted
assigns, for the proper use as a temporary drainage easement, for so long as used for
such purposes, and if the use of said temporary drainage easement be ever
abandoned, then, in that event, the aforesaid rights and privileges shall cease.
Executed in triplicate, either copy of which constitutes an original.
DEVELOPER(S)
The person signing this easement as Developer or on behalf of the Developer,
represents, warrants, and guarantees that they are the Developer or have the authority
to act on behalf of the Developer for purposes of this easement.

Field Notes for a 50.00 foot wide temporary drainage easement out of the North Half of Section 32,
Laureles Farm Tracts, a map of which is recorded in Volume 3, Page 15, Map Records of Nueces County, Texas
(M.R.N.C.T.); said easement being more fully described by metes and bounds as follows:
Commencing, at the intersection of the northwest boundary of South Oso Parkway, a public roadway, with
the south boundary of Lago Vista Dr, a public roadway, for the southerly corner of Lot 29, Block 5, The Coves at
Lago Vista Subdivision Unit 1, a map of which is recorded in Volume 65, Page 98 -101, M.R.N.C.T.;
Thence, South 49 1 03'06" East, along the southerly right-of-way line of Lago Vista Drive, a distance of
232.59 feet;
Thence, South 43 West, a distance of 160.11 feet for the point of beginning and the most northerly
corner of this easement;
Thence, South 49 °03'06" East, a distance of 50.03 feet, for the most easterly corner of this easement;
Thence, South 43 0 01'42" West, a distance of 983.18 feet, to the point of curvature of a circular curve to the
right whose radius point bears North 46 °58' 18" West a distance of 325.00 feet, having a central angle of 26 0 29 1 47 ",
a radius of 325.00 feet, a tangent length of 76.52 feet and an are Iength of 150.30 feet, for a corner of this easement;
Thence, along said circular curve to the right, an arc length of 150.30 feet, for a corner of this easement;
