HomeMy WebLinkAboutC2012-316 - 9/11/2012 - NANOTICE OF CONFIDENTIALITY RIGHTS: IF YOU ARE A NATURAI, PERSON, YOU MAY REMOVE OR STRIKE ANY OF THE FOLLOWING INFORMATION FROM THIS INSTRUMENT BEFORE IT iS FILED FOR RECORD IN THE PUBLIC RECQRDS: YOUR SOCIAL SECURITY NUMBER OR YOUR DRIVER'S LICENSE NUMBER. ,TEMPORARY DRAINAGE EASEMENT STATE OF TEXAS § --? 01203544 3 § KNOW ALL BY THESE PRESENTS: COUNTY OF NUECES § Aity Enterprises, inc., a Texas corporation ('Grantor"), whose address is 3801 Cassowary Court, Corpus Christi, Texas 78414, for and in oonsideration of the sum of One and no1100 Dollar ($1.00) paid by the City of Corpus Christi, Texas, a Texas home - rule municipal corporation, ( "Grantee "), of 1201 Leopard Street, Corpus Christi, Texas 78401, the receipt of which is acknowledged, has granted, sold, and conveyed and by these presents does grant, sell, and convey - to the City, its successors, legal representatives, permitted assigns and franchisees, the free and uninterrupted Oise, liberty, privilege, and easement of going in, on over, under, and along a certain tract of land situated in Nueces County, Texas, and being described as follows: Field note description for a temporary drainage easement out of Lot 4, Section 25, Flour Bluff & Encinal Farm & Garden Tracts, as shown on the map recorded in Volume A, Pages 41-43, Official Deed and Map Records of Nueces County, Texas, which description is attached to and incorporated in this document as "Exhibit A" and depicted on the location map attached to and incorporated in this document as "Exhibit B," the exhibits collectively being referred to and known as the "Premises." The Grantor also grants and conveys to the Grantee the rights of free ingress, egress, and regress to and'for the Grantee, all for the purpose of owning and keeping temporary drainage facilities and for the purposes of maintaining, servicing, repairing and inspecting said drainage facilities under, on, and along said tract. The Grantor shall construct a temporary drainage channel from the existing underground system in accordance with plans and specifications provided to and approved by the Grantee's Director of Engineering Services, or designee ( "Director"). When the surrounding property is platted, permanent underground storm drainage improvements shall be constructed by the Grantor in accordance with the Unified Development Code. Until the permanent underground storm drainage improvements are constructed in this temporary drainage easement, as required of the Grantor in future platting, Grantor shall maintain said temporary drainage facility to ensure it provides offsite drainage to the existing City of Corpus Christi drainage ditch. Grantor shall maintain and repair said temporary drainage facility within 30 days of the Director's written notice of the type of maintenance or repairs needed. If Grantor does not timely complete maintenance or repairs, Grantee may provide the needed maintenance or repairs and bill Grantor for the Grantee's expense which the Grantor covenants to pay within 30 days after Director's invoice is received, Grantor is deemed to receive the invoice three days after it is mailad to Grantor at the address above. 2012 -316 9/11/12 Alty Enterprises Inc.
