Atty Enterpises, Inc., a Texas corporation ("Grantor"), whose address is 3801
Cassowary Court, Corpus Christi, Texas 78414, for and in consideration of the sum of
One and no /100 Dollar ($1.00) paid. by the City of Corpus Christi, Texas, a Texas home -
rule municipal corporation ("Grantee"), of 1201 Leopard Street, Corpus Christi, Texas
78401, the receipt of which is acknowledged, has granted, sold, and conveyed and by
these presents does grant, sell, and convey to the Grantee, its successors, legal
representatives, permitted assigns and franchisees, the free and uninterrupted use,
liberty, privilege, and easement of going in, on, over, under, and along a certain tract of
land situated in Nueces County, Texas and being described as follows:
Field note description for a temporary waterline easement out of Lot 4,
Section 25, Flour Bluff & Encinal Farm & Garden Tracts, as shown on the
map recorded in Volume A, Pages 41-43, Official Deed and Map Records
of Nueces County, Texas, which description is attached to and
incorporated in this document as "Exhibit A" and depicted on the location
map attached to and incorporated in this document as "Exhibit B," the
exhibits collectively being referred to and known as the "Premises."
The Grantor also grants and conveys to the City the rights of free ingress, egress, and
regress to and for the Grantee, all for the purpose of owning and keeping temporary
waterline facilities and for the purposes of maintaining, servicing, repairing and
inspecting said waterline facilities under, on, and along said tract.
The Grantor shall construct a temporary waterline facility from the proposed permanent
public waterlines in accordance with plans and specifications provided to and approved
by the Grantee's Director of Engineering Services, or designee ( "Director"). When the
surrounding property is platted, the temporary waterline will be capped and abandoned
by the Grantor and permanent underground waterline improvements shall be
constructed by the Grantor in accordance'with the Unified Development Code.
Until the permanent underground waterline improvements are constructed In this
temporary waterline easement, as required of the Grantor in future platting, Grantor
shall, maintain said temporary waterline facility. Grantor shall maintain and repair said
temporary waterline facility within '30 days of the Director's written notice of the type of
maintenance or repairs needed. If Grantor does not timely complete maintenance or
repairs, Grantee may provide the needed maintenance or repairs and bill Developer for
the Grantee's expense which the Grantor covenants to pay within 30 days after

Director's invoice is received. Grantor is deemed to receive the invoice three days after
it is mailed to Grantor at the address above.
TO HAVE. AND TO HOLD, all and singular, the rights and privileges as describe above
to the Grantee, its successors, legal representatives, permitted assigns and
franchises, for the proper and public use as a temporary waterline easement and for
so long as used for such purposes and, if the use of said temporary waterline easement
be ever abandoned, then, in that event, the aforesaid rights and privileges shall cease.
Executed in triplicate, each of which constitutes an original.
GRANTOR
The person signing this easement as Grantor, or on behalf of the Grantor, represents,
warrants, and guarantees that they are the Grantor or have the authority to act on
behalf'of the Grantor for purposes of this easement.

County, Texas (MRN.C.T.); said easement being more fully described by metes and bounds as follows: .
Commencing at a 518 inch iron rod with red plastic cap stamped t° Urba1 Eng C.C. Tx" fund on the south
boundary of Slough Road (County Road 26) for the easterly comer of lot 13, Block 2, Greystone Subdivision Unit
2, amap ofwhichis recorded in Volume 66, Page 197 -198, M.R.N.C.T.;
Thence, South 61 0 00'00" Bast, along the southerly right -of -way line of said Slough Road (County Road
26), a distance of 281.24 feet;
Thence, South 29 °00'00" West, a distance of 909.99 feet for the Point of Beginning and for the most
northerly corner of this easement;
Thence, South 61 East, a distance of 15.00 feet for the most easterly corner of this easement;
Thence, South 28 0 55'40" West, a distance of 252.81 feet for the point of curvature of a non - tangent curve
to the right whose radius point bears North 31" West, a distance of 36.00 feet, having a cerrtral angle of
33"28'1 V, a radius of 36.00 feet, a tangent length of 10.82 foot and an arc length of 21.03 feet;
Thence along said non - tangent curve to the right an arc length of 21.03 feet for the most southwesterly
