addresses are 14622 Villa Maria Isabel, Corpus Christi, Texas 78418, and 14618 Villa Maria
Isabel, Corpus Christi, Texas 78418, respectively, County of Nueces, State of Texas for and in
consideration of the sum of One and no1100 Dollar ($1.00) to it in hand paid by the City of
Corpus Christi Texas, a Texas home -rule Municipal Corporation, duly incorporated under and
by virtue of the laws of the State of Texas ( "Grantee "), of 1201 Leopard Street, Corpus Christi,
Texas 78401, County of Nueces, State of Texas, the receipt of which is acknowledged, has
granted, sold and conveyed, and by these presents does grant, sell and convey to the City of
Corpus Christi, its successors, legal representatives, permitted assigns and franchisees, the
free and uninterrupted use, liberty, privilege, and easement, of going in, on, over, under, and
along a certain tract of land situated in Nueces County, Texas and being described as follows:
See the metes and bounds property description for a tract of land containing 0.01 Acres
(414 Sq. Ft.) of land out of Lots 11 and 12, Block 43, Padre Island No. 2, a map of which
is recorded in Volume 13, Page 28 of the Map Records of Nueces County, Texas
attached and incorporated as "Exhibit A."
See the map showing the location of the access easement, attached and incorporated
as "Exhibit B."
Together with the free ingress, egress, and regress to and for the City of Corpus Christi, Texas,
all for the purpose of erecting thereon a public accessway for the passage of pedestrians,
including the right to make the improvements to such accessway and according to such plans
and specification as will, in its opinion, best serve the public purpose.
TO HAVE AND TO HOLD, all and singular, the rights and privileges as described above to the
City of Corpus Christi, Texas, its successors, legal representatives, permitted assigns, and
franchisees for the proper use as a unimproved access easement and, for so long as used for
such purposes, and if the use of said easement be ever abandoned, then, in that event, the
aforesaid rights and privileges shall cease.
Executed in triplicate, any copy of which constitutes an original.

Ordinance amending Ordinance No. 028064, with regard to the condition
noted at SECTION 2.a., by replacing former Exhibit B with the
current Exhibit B, pages 1 thru 3; and by deleting the last sentence.
Whereas, on or about February 10, 2005, Robert Bryan Gulley and Shannon H. Gulley,
owners of Padre Island No. 2, Lot 13, Block 43, and Jerry C. Eaton, owner of Padre
island No. 2, Lot 12, Block 43, requested, and the City of Corpus Christi City Council
approved, see Ordinance No. 028064, the abandonment and vacation of an
undeveloped and unsurfac ed dedicated public alley right-of-way, located between Lots
12 and 13, Block 43, Padre Island No. 2, in order to improve security and facilitate
maintenance of the area; and
Whereas, the original parties to Ordinance No.' 028064, seek amendment to a portion of
said ordinance, specifically with regard to the condition noted at SECTION 2.8. by
replacing former Exhibit B with the current Exhibit B, pages 1 thru 3 so as to provide a
correct metes and bounds description along with a correct map depicting the public
alley right-of-way, located between Lots 11 and 12, Block 43, Padre Island No. 2; and
by deleting the last sentence of the condition noted at SECTION 2.a. as the provision
was not agreed to by the parties.
WHEREAS, it has been determined, during a meeting of the City Council, on Tuesday_
April 24, in the Council Cha rs
mb , afCify Fall, in the . City ( df Corpus Christi, that it is
advantageous to the City of Corpus Christi that Exhibit B be replaced, with Exhibit B,
pages I thru 3, and that the last sentence of the condition noted at SECTION 2.a, be
deleted .
Now, therefore, be It ordained by the City Council of the City of Corpus Christi,
Texas, that
Section 1. Ordinance No. 028064 is amended by replacing former Exhibit B with the
current Exhibit B, pages 'I thru 3 so as to provide a correct metes and bounds
description along with a correct map depicting the public alley right -of -way, located
between Lots 11 and 12, Block 43, Padre Island No. 2; and by deleting the last
sentence of the condition noted at SECTION 2.a., as the provision was not agreed to by
the parties. See amendments to the condition noted at SECTION 2.a. below:

Section 2. Considering the above and forgoing, the condition noted at SECTION 2.a. of
Ordinance No. 028064 shall now read as follows:
