Home My WebLink AboutC2012-380 - 8/14/2012 - ApprovedSTATE OF TEXAS § COUNTY OF TRAVIS §: This agreement supplements the previously executed Master Multiple Use Agreement for bulkhead: repair, boat ramp repair and parking facilities with lighting on Texas Department of Transportation Right -of -'Way within Nueces County dated the 2nd day of March , 1979 by and between the Texas Department of Transportation, hereinafter referred to as "State ", and the City of Corpus Christi, Texas hereinafter referred to as the "City ". The effective date of this Supplemental Agreement is that date on which the State affixed its signature. W1TINESSETH WHEREAS, the City has requested the .State to permit the repairs to the bulkhead, goat ramp and parking facilities with lighting, located within State. right -of -way of Park Road 22 on the John F. Kennedy Memorial Causeway _ in Nuece CoIA ... , and being more particularly described in the exhibits attached hereto and made a part hereof, and WHEREAS, the State is willing to approve the establishment of such repairs as evidenced by the State Highway Commission Minute Order Number 65164 and the City has complied with all conditions of State Highway Commission Minute Order 65164 by the execution of a Master Agreement for Construction, Maintenance, and Operation of the bulkhead repair, boat ramp repair and parking facilities with lighting on Texas Department of Transportation right -of -way; and NOW, THEREFORE, Sidewalks, curb, ramps and other pedestrian elements to be constructed by the City shall be in accordance with the requirements of Title 11 of the American with Disabilities Act (ADA) and with the Texas Accessibility Standards (TAS). Elements constructed by the City and found not to comply with ADA or TAS shall be corrected at the entire expense of the City. The City shall submit the plans to the Texas Department of Licensing and Regulation. (TDLR) for review and inspection. The City shall furbish TxDOT with a TDL.R Certification of Substantial compliance for this project, and 2012 -350 Pagel of.3 8/14/12 Res. 029587 TXDOT INDEXED NOW, THEREFORE, TxDOT has made it a. policy to be a proactive participant of the environment, It is the intent of this office., along with the City, to show a "good faith effort" with regards to this construction project and the prevention of any adverse effects to the environment during construction. activities and NOW, THEREFORE, for all project- specific locations (PSL's) on or off the right of way (material sources, waste sites, parking areas, storage areas, field offices, staging areas, haul. roads, etc..), signing the Agreement certifies compliance with all applicable laws, rules and regulations pertaining to the preservation of cultural resources, natural resources, and the environment as issued by the following or other agencies: Occupational Safety and Health Administration, Texas Commission on Environmental Quality .(TCEQ), Texas Department of Transportation, Texas Historical Commission, Texas Parks and Wildlife Department, Texas Railroad Commission, U.S. Army Corps of Engineers, U.S. Department of Energy, U.S. Department of Transportation, U.S. Environmental Protection Agency, U.S. Federal Emergency Management Agency, and the U.S. Fish and Wildlife Service and NOW, THEREFORE, it is understood that any uses contemplated under this Agreement is subject to the rights of the United States of America as described in that certain .Spoil Disposal and Right -of -Way Easement Deed filed in the real property records of Nueces County, Texas on November 13, 1947 in Vol_ 382, Page 307, Clerk's filing no. 250736. NOW, THEREFORE, in consideration of the .premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed as set forth in the Master Agreement; the City is hereby granted :permission for construction, maintenance . and operation of the bulkhead repair, boat ramp repair and parking facilities with lighting on State right- of=way of __ Park Road 22 on the John .F.
