HomeMy WebLinkAboutC2012-402 - 11/6/2012 - NA1 y Dc3-=I 2AMA1 044467 DEPARTMENT OF ENGINEERING SERVICES PROPERTY AND LAND ACQUISITION DIVISION Oso Effluent Reuse Distribution System, Parcel 1, Proj #E 35 THE STATE OF TEXAS COUNTY OF NUECES UTILITY EASEMENT KNOW ALL BY THESE PRESENTS: THAT, APEX GOLF PROPERTIES CORPORATION, a Texas corporation, of 13546 Bullion Court, Corpus Christi, Texas 78418, ( "GRANTOR") in consideration of TEN DOLLARS ($10.00), paid by the CITY OF CORPUS CHRISTI, TEXAS, herein called ( "GRANTEE "), of 1241 Leopard Street, Corpus Christi, Nueces County, Texas 78469 -9266, the receipt of which is hereby acknowledged, has granted, sold and conveyed and does hereby grant, sell and convey to Grantee, a Texas Horne Rule municipal corporation, its successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See the metes and bounds property description attached and incorporated as "Exhibit A ", and a map showing the location of the UTILITY EASEMENT TOGETHER WITH A TEMPORARY CONSTRUCTION EASEMENT is attached and incorporated as "Exhibit B ". ( "Premises ") The Temporary Construction Easement is further described as a 30' wide and adjacent to the permanent Utility Easement. Said Temporary Construction Easement is to be used for working space during construction. This Temporary Construction Easement automatically terminates upon: i) 185 days from the start of construction on the premises, or ii) one year from the recording date of this instrument, whichever occurs first. SPECIAL PROVISIONS: The City of Corpus Christi agrees to restore the land within the easement area to the same or better condition as existed prior to construction. All construction is to be done in a prudent and workmanlike manner. Together with the free ingress, egress and regress to and for Grantee, and its franchisees to construct, service, repair, maintain, inspect, lay, operate and keep public utility lines under, on and along said Premises.
