UTILITY EASEMENT
KNOW ALL BY THESE PRESENTS:
THAT, APEX GOLF PROPERTIES CORPORATION, a Texas corporation, of 13546 Bullion
Court, Corpus Christi, Texas 78418, ( "GRANTOR") in consideration of TEN DOLLARS
($10.00), paid by the CITY OF CORPUS CHRISTI, TEXAS, herein called ( "GRANTEE "), of
1241 Leopard Street, Corpus Christi, Nueces County, Texas 78469 -9266, the receipt of which is
hereby acknowledged, has granted, sold and conveyed and does hereby grant, sell and convey to
Grantee, a Texas Horne Rule municipal corporation, its successors and legal representatives, the free
and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a
certain tract of land situated in Nueces County, Texas and being described as follows:
See the metes and bounds property description attached and incorporated as
"Exhibit A ", and a map showing the location of the UTILITY EASEMENT
TOGETHER WITH A TEMPORARY CONSTRUCTION EASEMENT is
attached and incorporated as "Exhibit B ". ( "Premises ")
The Temporary Construction Easement is further described as a 30' wide and
adjacent to the permanent Utility Easement. Said Temporary Construction
Easement is to be used for working space during construction. This Temporary
Construction Easement automatically terminates upon: i) 185 days from the
start of construction on the premises, or ii) one year from the recording date of
this instrument, whichever occurs first.
SPECIAL PROVISIONS:
The City of Corpus Christi agrees to restore the land within the easement area
to the same or better condition as existed prior to construction. All construction
is to be done in a prudent and workmanlike manner.
Together with the free ingress, egress and regress to and for Grantee, and its franchisees to construct,
service, repair, maintain, inspect, lay, operate and keep public utility lines under, on and along said
Premises.
TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to Grantee,
its successors, legal representatives, and franchisees for the use as a UTILITY EASEMENT and
right -of -way for so long as used for such purpose, and if the use of said easement and right of way is
_ - ., . aforesaid rights and privileges cease.

Fieldnotes for a 30.00 foot wide and 35.00 foot wide utility easement out of Tract 2, The Pharaoh Country Club, a
map of which is recorded in Volume 33, Page 69, Map Records of Nu Ices County, Texas; said easement being more fully
described as follows:
Beginning at a point (no monumentation found or set) on northeast boundary of McArdle Road, a public roadway, for
the west comer of Lot 1, Block 19, Pharaoh Valley Southwest Unit 1, a map of which is recorded in Volume 28, Page 94, Map
Records of Nucces County, Texas, for the southerly comer of said Tract 2, The Pharaoh Country Chub and for the south corner
of this easement and from which Point of Beginning a National Geodetic Survey monument stamped "SQ-090" bears South
42 °54'07" West 10,737.85 feet and another National Geodetic Survey monument stamped "SR -090" bears South 29
West 18,607.76 feet;
Thence, North 61°23'40" West, with the northeast boundary of said McArdle Road, same being the southwest
boundary of said Tract 2 and of this easement, a distance of 35.00 feet for the west corner (no monumentation found or set) of
this easement;
Thence, North 28°3T30' East, with the northwest boundary of this easement, parallel with the common boundary of
said Tract 2, The Pharaoh Country Club and said Block 19, Pharaoh Valley Southwest Unit 1 and 35.00 feet distant there
from, measured at right angles therfo, a distance of 199.75 feet for the point of curvature (no monumentation found or set) of a
circular curve to the right has a delta angle of 87°4326 ", a radius of 620.50 feet, a tangent length of 596.32 feet ahhd an arc
length of 950.02 feet;
Thence, with said circular curve to the right, same being the northwest boundary of this easement, an arc length. of
