UTILITY EASEMENT
KNOW ALL BY THESE PRESENTS:
THAT, DUDIU A, INC., A Texas Corporation, of 11217 IH 37., Corpus Christi, Texas 78410,
( "GRANTOR") in consideration of TEN DOLLARS ($10.00), paid by the CITY OF CORPUS
CHRISTI, TEXAS, herein called ( "GRANTEE "), of 1201 Leopard Street, Corpus Christi, Nueces
County, Texas 78469 -9266, the receipt of which is hereby acknowledged, has granted, sold and
conveyed and does hereby grant, sell and convey to Grantee, a Texas Home Rule municipal
corporation, its successors and legal representatives, the free and uninterrupted use, liberty, privilege,
and easement of going in, on, over, under and along a certain tract of land situated inNueces County,
Texas and being described as follows:
See the metes and bounds property description attached and incorporated as
"Exhibit A" and "Exhibit C", and a map showing the location of the UTILITY
EASEMENT TOGETHER WITH A TEMPORARY CONSTRUCTION
EASEMENT attached and incorporated as "Exhibit B" and "Exhibit D ".
"Premises ")
The Temporary Construction Easement is further described as a 30' wide and
adjacent to the permanent Utility Easement only on Lot 4A. Said Temporary
Construction Easement is to be used for working space during construction.
This Temporary Construction Easement automatically terminates upon: i) 185
days from the start of construction on the premises, or ii) one year from the
recording date of this instrument, whichever occurs first,
SPECIAL PROVISIONS:
The City of Corpus Christi agrees to restore the land within the easement area
to the same or better condition as existed prior to construction. All construction
is to be done in a prudent and workmanlike manner.
Together with the free ingress, egress and regress to and for Grantee, and its franchisees to construct,
service, repair, maintain, inspect, lay, operate and keep underground public utility lines, on said
Premises. All utility lines must be underground. The easement herein granted is non - exclusive, and
Grantor shall continue to have use of the surface of the property for driveways and parking areas.
TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to Grantee,
its successors, legal representatives, and franchisees for the use as a UTILITY EASEMENT and
right -of -way for so long as used for such purpose, and if the use of said easement and right of way is
ever abandoned, then the aforesaid rights and privileges cease.

Fieldnotes for a 20.00 foot wide utility easement out of Lot 4B, Padre Plaza, a map of which is recorded in Volume
67, Pages 459 and 460, Map Records of Nueces County, Texas; said easement being more fully described as follows:
Beginning at a concrete monument with brass disc found on the southwest boundary of South Padre Island Drive
(State Highway 358) for the north corner of Lot 8, Block 1, Lexington Park Unit 3, a map of which is recorded in Volume 54,
Page 78, Map Records of Nueces County, Texas, for the east corner of said Lot 4B and for the east corner of this easement and
from which Point of Beginning a National Geodetic Survey monument stamped "SQ -090" bears South 45 °04'51" West
9,235.59 feet and another National Geodetic Survey monument stamped "SR -090" bears South 29 0 25 1 53" West 17,058.55 feet;
Thence, South 28 °41'21" West, with the common boundary of said Lot 4B and said Lot 8, same being the southeast
boundary of this easement, a distance of 451.49 feet, for an east corner of Lot 4A, Padre Plaza, a map of which is recorded. in
Volume 67, Pages 459 and 460, Map Records of Nueces County, Texas, for the south corner of said Lot 4B and for the south
corner (no monumentation found or set) of this easement;
Thence, North 6I °21'49" West, with the common boundary of said Lots 4B and 4A, same being the southwest
boundary of this easement, a distance of 20.00 feet for the west corner (no monumentation found or set) of this easement;
Thence, North 28 0 41 1 21" East, with th6 i fib'rthwest boundary of this easement, a distance of 450.77 feet to the
aforementioned southwest boundary of South Padre Island Drive for the north (no monumentation found or set) corner of this
tract;
Thence, South 63 °25'20" East, with the southwest boundary of said South Padre Island Drive , same being northeast
boundary of said Lot 4B and of this easement, a distance of 20.01 feet to the Point of Beginning and containing 9,022.585
square feet (0.207 acres) of land.
Description prepared from previous surveys and a current on the ground survey. No monumentation was found or set
at corners unless otherwise noted. Bearings based on GPS bearings, NAD83, Texas South Zone. National Geodetic Survey
monuments "SQ -090" (North coordinate = 17,137,240.0980 East coordinate = 1,350,222.1730) and "SR -090" (North
coordinate = 17,128,904.3860 East coordinate = 1,348,379.6700) were used as control points for establishing basis of bearing.
Coordinates shown are based on Texas State Plane Coordinate System, South Zone (NAD83).
