THAT Arnold Brothers Properties, LP, a Texas limited partnership ( "Grantor"), whose
address is 5440 -B Ayers St., Corpus Christi, Nueces County, Texas 78415, for and in
consideration of the sum of One and no1100 Dollar ($1.00) paid by the City of Corpus
Christi, Texas, a Texas home -rule municipal corporation ( "Grantee "), whose address is
1201 Leopard Street, Corpus Christi, Nueces County, Texas 78401, the receipt of which
is acknowledged, has granted, sold, and conveyed and by these presents does grant,
sell, and convey to the Grantee, its successors, legal representatives, permitted assigns
and franchisees, the free and uninterrupted use, liberty, privilege, and easement of
going in, on, over, under, and along a certain tract of land situated in Nueces County,
Texas, and being described as follows:
Field note description for an additional 5' for utility easement over and across
portions of Lots 22 -A and 22 -B, Holly Industrial Subdivision, as shown on the
map"-thereof recorded in Volume 54, Page 66, of the Official Deed and Map
Records of Nueces County, Texas, which description is attached to and
incorporated in this document as "Exhibit A" and depicted on the location map
attached to and incorporated as "Exhibit B," the exhibits collectively being
referred to and known as the. "Premises."
Together with the free ingress, egress, and regress to and for the Grantee, all for the
purpose of erecting, constructing, installing, laying, replacing, servicing, repairing, using,
maintaining, inspecting, reconstructing, modifying, removing, operating, and keeping
utility lines in, on, over, under, and along the Premises including, but not limited to,
water, wastewater, storm water, storm water detention, filtration, drainage, and gas,
together with all lines, pipes, conduits, and other equipment, improvements, and
appurtenances used in the supply and provision of public utilities.
TO HAVE AND TO HOLD, all and singular, the rights and privileges as describe above
to the Grantee, its successors, legal representatives, permitted assigns, and
franchisees, for the proper use as a utility easement and for so long as used for such
purposes and, if the use of said easement be ever abandoned, then, in that event, the
aforesaid rights and privileges cease.

Being a tract situated in Corpus Christi, Nueces County, Texas, over and across portions of Lots 22, -A and
22 -13, Holly Industrial Subdivision, as shown on the map thereof recorded in Volume 54, at Page 66 of the Map
Records of Nueces County, Texas and being and more particularly described by metes and bounds as
follows:
BEGINNING at a point in the east margin of an existing 10.0 foot utility easement shown on the heretofore
referenced map of Lot 22 -A, Holly Industrial Subdivision, whence the west most corner of Lot 22 -A bears
S 29 0 00'00" W 15.0 feet, N 61 °30'30" W 10.0 feet;
THENCE S61 °30'30 "E 15.0 feet northeast of and parallel to the southwest line of Lot 22 -A and Lot 22 -B a
distance of 559.55 feet to a point for the eastmost corner of this tract;
THENCE S 28 0 29'30" W a distance of 5.0 feet to a point for the southmost corner of this tract, said point lying
in the northeast margin of an existing 10.0 foot wide utility easement shown on the heretofore referenced map
of Lots 22 -A and 22 -13, Holly Industrial Subdivision;
THENCE. N 61 W along the northeast margin of the existing 10.0 utility easement a distance of 559.59
feet to a point in the east margin of the heretofore referenced existing 10.0 foot utility easement along the
