Double T & C Properties, Inc., a Texas corporation ( "Grantor"), whose address is 4455
South Padre Island Drive, Suite 34, Corpus Christi, Texas, 75411, for and in
consideration of the sum of One and No/100 Dollar ($1.00) paid by the City of Corpus
Christi, a Texas home -rule municipal corporation ( "Grantee "), whose address is 1201
Leopard Street, Corpus Christi, Texas, 78401, the receipt of which is acknowledged,
has granted, sold, and conveyed and by these presents does grant, sell, and convey to
the Grantee, its successors, legal representatives, permitted assigns and franchisees,
the free and uninterrupted use, liberty, privilege, and easement of going in, on, over,
under, and along a certain tract of land situated in Nueces County, Texas, and being
described as follows:
Field note description by metes and bounds of a 15 -foot wide utility
easement over and across portions of Tract 13, Celanese Research Tracts
A & 13, as shown on the map recorded in Volume 26, Page 4, Official Deed
and Map Records of Nueces County, Texas, which description is attached
to and incorporated in this document as "Exhibit A," and which field notes
map is attached to and incorporated in this document as "Exhibit B," and
which geographical location is depicted on the location map attached to
and incorporated in this document as "Exhibit C," the exhibits collectively
being referred to and known as the "Premises."
Together with the free ingress, egress, and regress to and for the Grantee, all for the
purpose of erecting, constructing, installing, laying, replacing, servicing, repairing, using,
maintaining, inspecting, reconstructing, modifying, removing, operating and keeping
utility lines in, on, over, under, and along the Premises, including but not limited to
water, wastewater, storm water, storm water detention, filtration, drainage, and gas, and
together with all lines, pipes, conduits, and other equipment, improvements, and
appurtenances used in the supply and provision of public utilities.
TO HAVE AND TO HOLD, all and singular, the rights and privileges as described above
to the Grantee, its successors, legal representatives, permitted assigns, and
franchisees, for the proper and public use as a utility easement and for so long as used
for such purposes and, if the use of said utility easement be ever abandoned, then, in
that event, the aforesaid rights and privileges shall cease.

Being a 0.69 acre tract of land out of Tract B, Celanese Research Tracts A & B as
described in Volume 26, Page 4, of the Map Records of Nueces County, Texas, said
0.69 acre tract being more fully described by metes and bounds as follows_
COMMENCING at a 518 -inch iron rod found for the Southeast corner of Tract B,
Celanese Research Tracts A & B, as recorded in Volume 26, Page 4, of the Map
Records of Nueces County, Texas, said point lying along the West Right -Of -Way Line of
Clarkwood Road (a 60.0 -Foot Public Right -Of Way);
THENCE North 00° 04'00" East, along the West Right -Of -Way Line of said Clarkwood
Road and the East Boundary Line of Said Tract B, a distance of 376.85 feet to a point
lying along the West Right -Of -Way Line of said Clarkwood Road and the East Boundary
Line of said Tract B, for the Southeast corner of this easement, and POINT OF
BEGINNING;
THENCE North 89° 53' 30" West, a distance of 1999.50 feet to a point lying along the
West Boundary Line of said Tract B for the Southwest comer of this easement;
THENCE North 00" 04' 00" East, along the West Boundary Line of said Tract B, a
distance of 15.00 feet to a point for the Northwest comer of this easement;
THENCE South 89° 53' 30" East, a distance of 1999.50 feet to a point lying along the
