In the original contract, Section I. SCOPE OF SERVICES, Part A. Basic Services, 2. Design Phase shall be
amended to include additional Design Phase as shown in the attached Amendment No. 7. Exhibit "A " , 4.
Construction Phase shall be amended to include additional Construction Phase as shown in the attached
Amendment No. 7, Exhibit "A "_
■ In the original contract, Section Ill. FEES shall be modified as shown on the attached Amendment No. 7 Exhibit "B"
for a fee not to exceed $34,060.00 (Thirty Four Thousand Sixty Dollars and Zero Cents), for a total restated fee
not to exceed $1,816,205.00 (One Million Eight Hundred Sixteen Thousand Two Hundred Five Dollars and Zero
Cents). Monthly invoices will be submitted in accordance with Exhibit "C ".
All other terms and conditions of the April 24, 2009 contract and amendments between the City and Consultant will remain
in full force and effect.

Freese and Nichols, Inc. (FNI) respectfully submits our Amendment No. 7 for your consideration. The
tasks outlined in our amendment are as follows:
1. Coordinate Yorktown /Rodd Field intersection improvements with Airline /Rodd Field Road design
team
2. Provide realignment drawings for 4" and 8" gas lines
3. Coordinate with City's Legal Department on use of EJCDC documents
4. Prepare EJCDC documents for inclusion into overall project contract document
5. Provide additional construction support for gas line realignment
FNI .would request a contract amendment in the amount of $34,060 for the aforementioned out of
scope services.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the City
Council of the City of Corpus Christi, Texas.
b. "Economic benefit ". An action that is likely to afTect an economic interest if it is likely to have an
effect on that interest that is distinguishable from its effect on members of the public in general or a
substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part -
time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or commercial, and
whether established to produce or deal with a product or service, including but not limited to, entities
operated in the form of sole proprietorship, as self - employed person, partnership, corporation, joint
stock company, joint venture, receivership or trust, and entities which for purposes of taxation are
treated as non- profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City Manager,
Assistant City Managers, Department and Division Heads, and Municipal Court Judges of the City of
Corpus Christi, Texas.
