Olson 1201 Leopard St. Corpus Christi, TX 78401 Ref Interlocal Agreement with TAMU-CC National Spill Control School REQUEST FOR ADOPTION OF AMENDMENT #1 Dear Mr. Olson: On April 9, 2013 a resolution was brought before City Council to enter into an Interlocal Agreement with TAMU-CC National Spill Control School. The resolution was passed, File#13- 000297 Version: 1. The University had moved forward with the agreement as it was written for ease of passage through the council. At this time we would like to respectfully request a minor change to the agreement. Texas A&M System bylaws prohibit the University from entering into contracts with a duration of longer than five years unless, approved by the Board of Regents (BOR). Since this agreement was completed at the local level and not reviewed by the BOR, we suggest an end to the term of the agreement at the fifth anniversary, April 9, 2018. This change would allow us to be in compliance with our System rules. I have drafted an amendment to the agreement that places this term limit on the agreement. Of course, if at that time, both the City of Corpus Christi and TAMUCC are satisfied, we may adopt a new agreement to allow continuation of our relationship. if this Amendment#1 is acceptable, please sign and return a copy to me. Term of Agreement The City of Corpus Christi acknowledges that TAMUCC is an Agency of the State of Texas and is therefore; subject to the Constitution and all Laws of the State of Texas. Authorization to enter into agreements for periods up to five years in length is delegated by those boards duly appointed to oversee University operations. Notice is given that,as directed by Texas A&M University System rules and TAMUCC procedures,this agreement shall terminate April 9,2018. THE' JTY CO S 'I By L.
