RATIFICATION OF
AMENDMENT NO. 5
TO CONTRACT FOR
PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "CITY", and LNV. Inc., hereinafter called
"ENGINEER," agree to the following amendment to the Contract for Professional Services for Oso Water
Reclamation Plant Nutrient Removal Prolect (Ammonia) (Proiect No. E09007), as authorized and
amended by:
Original AIE Agreement August 24, 2010 Motion No. 2010-197 $550,059.00
Amendment No. 1 January 17, 2012 Administrative Approval $49,600.00
Amendment No. 2 January 31, 2012 Motion No. 2012-028 $247,395.00
Amendment No. 3 January 18, 2013 Administrative Approval $48,900.00
Amendment No. 4 March 1, 2013 Administrative Approval $41,725.00
• Exhibit "A". SECTION 1. SCOPE OF SERVICES, PART B. ADDITIONAL SERVICES shall be
modified to include Oso WRP Phase 2 Cost/Benefit Evaluation as described in Amendment No. 5
Exhibit"A".
= The original contract SUMMARY OF FEES shall be modified and is attached as Amendment No. 5
Exhibit "A" for a revised fee not to exceed $39,956.00 (Thirty-Nine Thousand Nine Hundred Fifty
Six Dollars and Zero Cents), for a total restated fee not to exceed $977,635.00 (Nine Hundred
Thirty-Seven Thousand Six Hundred Seventy-Nine Dollars and Zero Cents). Monthly invoices
shall be submitted in accordance with Amendment No. 5 Exhibit"B"
All other terms and conditions of August 24, 2010 contract and amendments between the City and
Engineer will remain in full force and effect.

Dear Mr. Bites:
In response to City request, we are proposing the following small AIE amendment to the
above referenced contract for additional services as described below.
PROJECT DESCRIPTION &SCOPE OF SERVICES:
The City of Corpus Christi, Texas, hereinafter called 'City", and LNV, Inc. hereinafter
called "Engineer', agree to the following Contract for Basic and Additional Services
associated with the above referenced project. This effort includes several tasks
associated with the Oso Water Reclamation Plant Nutrient Removal Project (Ammonia)
which were not included in the original scope of work.
The supplemental task includes the development of a cost/benefit evaluation for the
Phase 2 Improvements with the purpose of providing the background information on the
drivers of the project, to describe the advantages/disadvantages of implementing the
improvements and to present a comparison of the cost impacts associated with
implementing Phase 2 Improvements versus not implementing the Phase 2
Improvements. The evaluation will be submitted as Technical Memorandum No. 9 and
will include specifics listed below.

conditions of the existing Oso WRP, Laguna Madre WWTP, & Greenwood

o Provide a discussion on the drivers for the Phase 2 Improvements

• Identify how Phase 2 Improvements align with the goals and strategies
adopted in the Wastewater Department's most recent Business Plan (FY2012-
2013)
• Describe & evaluate alternatives based on goals and objectives developed
during a workshop with project team and City staff
■ Identify Oso WRP Phase 2 improvements and provide associated
advantagesldisadvantages
■ Identify the capital improvements required if Phase 2 Improvements
are not implemented and provide associated
advantagestdisadvantages
• Develop a life-cycle cost estimates for Oso WRP & Laguna Madre WWTP over
an assumed 20 year period for the two following options:
• Provide the total cost incurred (including design, construction, and
O&M costs) for the Phase 2 Improvements. A preliminary estimate
of probable construction cost shall be provided for each of the
anticipated improvements as recommended in Technical
Memorandum No.6. In addition, Engineer will prepare a preliminary
estimate for the Laguna Madre WWTP Decommissioning &
Transfer.
• Provide the total cost incurred (including design, construction, and
O&M costs) for the other miscellaneous plant improvements
necessary if the Phase 2 Improvements are not implemented. A
preliminary estimate of probable construction cost shall be provided
for each of the following anticipated improvements:
• Greenwood WWTP Expansion to 12MGD, Disinfection
System Modifications & Chlorine Contact Basin Mechanical
Equipment Replacement, Digester No. 2, 3 & 4 Mechanical
Equipment Replacement, East & West Plant Aeration Basin
Rehabilitation including grit removal & diffuser replacement,
Influent Lift Station, Headworks, and Laguna Madre WWTP
Upgrades.
• O&M costs shall include all costs associated with labor, electrical,
chemicals, and maintenance & repairs that the City should be
expected to incur in order to maintain plant operations
• Discuss and estimate the range and scale of possible regulatory
fines & risks associated with not meeting the plant's TPDES
discharge permit
• Clearly identify and document all assumptions used in cost
estimates

o Compare project costs, O&M costs, and 20 year life-cycle costs for the Phase
2 Improvements and for the improvements necessary if the Phase 2
Improvements are not implemented. All costs shall be in 2013 dollars and
shall represent present value. Identify the scale of the estimated savings
resulting from the implementation of the Phase 2 Improvements.
o Provide project exhibits supporting the discussion in the memo and
documenting the general preliminary site plans, layouts and alignments. The
exhibits should provide the basis for the construction costs.
Meetings
o Attend up to 2 meetings with representatives from the City for
revlewldiscussion of technical memorandum.
Deliverables
o Draft Technical Memorandum
o Final Technical Memorandum
SCHEDULE:
All work under this contract shall be completed by the Engineer by April 31, 2013.
FEES:
A. Fee for Additional Services Authorized. The City will pay the Engineer a lump
sum fee not to exceed $&RU.�Q for provided services specified in this
contract. The fee will be full and total compensation for services and for all
expenses incurred in performing these services. Engineer will submit monthly
statements for basic services rendered. Each statement will be based on the
project percent completion at the time of billing. City will make prompt monthly
payments in response to Engineer's monthly statements.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the City
Council of the City of Corpus Christi,Texas.
b. "Economic Benefit". An action that is likely to affect an economic interest if it is likely to have an
effect on that interest that is distinguishable from its effect on members of the public in general or a
substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part-
time basis,but not as an independent contractor.
d. "Firm." Any entity operated for economic gain,whether professional,industrial or commercial,and
whether established to produce or deal with a product or service,including but not limited to,entities
operated in the form of sole proprietorship, as self-employed person, partnership, corporation,joint
