EXHIBIT "A", PART 1. SCOPE OF SERVICES, SECTION A. BASIC SERVICES, ITEM NO. 2 DESIGN PHASE
shall be amended to include Re-Design Lane Configuration„ ITEM NO. 4 CONSTRUCTION PHASE shall be
amended to include additional Construction Administration Services as set forth in the attached Amendment No.4
Exhibit"A'% and SECTION A.ADDITIONAL SERVICES,ITEM NO.5 CONSTRUCTION OBSERVATION shall be
amended to include additional Construction Observation as set forth in the attached Amendment No.4 Exhibit"A".
EXHIBIT"B"PART 3. FEES SECTION C.SUMMARY OF FEES shall be modified and is attached as Amendment
No. 4 Exhibit"B"for a fee not to exceed$38,769.00(Thirty Eiaht Thousand Seven Hundred Sixty Nine Dollars
and Zero Cents), for a total restated fee not to exceed $712,592.00 {Seven Hundred Twelve Thousand Five
Hundred Ninety Two Dollars and Zero Cents) Monthly invoices will be submitted in accordance with Exhibit"C".
All other terms and conditions of the July 21,2009 contract between the City and ENGINEER will remain in full force
and effect.

Amendment No.4—Re-Design Lane Configuration and Extended Construction Phase Services
Dear Mr. Biles:
Please allow this letter to serve as our formal request to amend our Contract to include additional services as
described below for the above referenced project. The fee for the amended scope of services is $38,769 for a
total revised contract amount of$712,592.
This amendment includes revising the pavement marking plans, signage plans and contract quantities to provide
a dedicated right-turn lane for westbound traffic on Wooldridge Road turning north onto Rodd Field Road. This
will also require a change order for the contractor since this street has already been striped.
This amendment also includes providing Construction Administration Services and Construction Observation
Services for an additional 2 months in excess of the original construction contract time. This is due to
extensions to the construction contract time granted by change order plus schedule overrun by the contractor.
The original construction contract time was 270 calendar days (9 months), which was the basis for determining
our fee for these services. The original construction completion date was April 27, 2013. The anticipated
completion date is June 28, 2013, but could be even later depending on the time required for the contractor to
eliminate the recently applied pavement markings and apply new markings.

DEFINTI'IONS
a. "Board member." A member of any board, commission, or committee appointed by the City
Council of the City of Corpus Christi,Texas.
b. "Economic Benefit". An action that is likely to affect an economic interest if it is likely to have an
effect on that interest that is distinguishable from its effect on members of the public in general or a
substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part-
time basis,but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional,industrial or commercial,and
whether established to produce or deal with a product or service, including but not limited to,entities
operated in the form of sole proprietorship, as self-employed person, partnership, corporation,joint
