TO CONTRACT FOR
PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "CITY", and FREESE AND NICHOLS INC., hereinafter called
"CONSULTANT," agree to the following amendment to the Contract for Professional Services for Yorktown Boulevard
Phase 1 Staples to Cimarron & Phase 2—Cimarron to Rodd Field (Project No. E10100), as authorized and amended
by:

Amendment No. 1 November 22, 2009 Administrative Approval $48,500.00
Amendment No. 2 April 9, 2010 Administrative Approval $48,000.00
Amendment No. 3 May 5, 2010 Administrative Approval $42,812.00
Amendment No. 4 August 17, 2010 Motion No. M2010-189 $636,003.00
Amendment No. 5 August 1, 2011 Administrative Approval $0.00
Amendment No. 6 July 19, 2012 Administrative Approval $6,959.00
Amendment No. 7 March 1, 2013 Administrative Approval $34,060.00
Amendment No. 8 July 23, 2013 Administrative Approval $21,105.00
• In the original contract, Section I. SCOPE OF SERVICES, Part A. Basic Services, 2. Design Phase shall be
amended to include additional Design Phase as shown in the attached AMD No. 9 Exhibit"A".
• In the original contract, Section III. FEES shall be modified as shown on the attached AMD No. 9 Exhibit"B" for a fee
not to exceed $22,052.00 (Twenty Two Thousand Fifty Two Dollars and Zero Cents), for a total restated fee not to
exceed $1,859,362.00 (One Million Eight Hundred Fifty Nine Thousand Three Hundred Sixty Two Dollars and
Zero Cents). Monthly invoices will be submitted in accordance with Exhibit"C".
All other terms and conditions of the April 24, 2009 contract and amendments between the City and Consultant will remain
in full force and effect.

Design Phase Services Amendment
Dear Mr. Biles,
Freese and Nichols, Inc. (FNI) would respectfully request your consideration of our proposed design
phase services amendment. The additional design services include a revised landscape and irrigation
design, striping plan modifications,and design of a loon at Bill Witt Park. FNI respectfully requests a
contract amendment in the amount of$22,052.00 to address the additional time and effort required to
support this project.

1. Develop a revised landscape and planting design for City approval
2. Develop a revised irrigation plan to eliminate all lawn sprinklers and add
drip irrigation to the new planting plan and hardscape layout
3. Provide revised landscape and irrigation construction documents and
revised specifications
4. Revise striping plans to reduce lane widths and add bicycle lane buffer
5. Develop design of a loon for U-turn near Bill Will Park. Revise paving and
drainage plans accordingly

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the City
Council of the City of Corpus Christi,Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to have an
effect on that interest that is distinguishable from its effect on members of the public in general or a
substantial segment thereof
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part-
time basis,but not as an independent contractor.
d. "Firm." Any entity operated for economic gain,whether professional, industrial or commercial,and
whether established to produce or deal with a product or service, including but not limited to,entities
operated in the form of sole proprietorship, as self-employed person, partnership, corporation,joint
stock company,joint venture, receivership or trust, and entities which for purposes of taxation are
treated as non-profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City Manager,
Assistant City Managers, Department and Division I-leads, and Municipal Court Judges of the City of
Corpus Christi,Texas.
f. "Ownership Interest." Legal or equitable interest, whether actually or constructively held, in a
firm, including when such interest is held through an agent, trust, estate, or holding entity.
"Constructively held" refers to holdings or control established through voting trusts, proxies, or
