HomeMy WebLinkAboutC2014-131 - 4/22/2014 - NA AMENDMENT NO. 1 AGREEMENT FOR CONSTRUCTION MATERIALS TESTING The City of Corpus Christi, Texas, hereinafter called "CITY", and KLEINFELDER CENTRAL, INC., hereinafter called "LAB", agree to the contract for Construction Materials Testing for the following project, as authorized and administratively amended by: Original Agreement December 9, 2010 Administrative Approval $6,500.00 1. DECLARATIONS: "CITY" desires to engage "LAB" to provide services in connection with City's project, described as follows: Padre Island Water Supply(Project No. E10172) ("PROJECT"). 2. SCOPE OF WORK: "LAB" shall provide services to the PROJECT in accordance with the accompanying Letter, Scope of Services, and Fee Schedule attached as Amendment No. 1 Exhibit"A". 3. FEE: The "CITY" agrees to pay the "LAB" for services provided in accordance with Amendment No. 1 Exhibit "A", Scope of Services and Fee Schedule under this AGREEMENT, a total fee not to exceed $19.500.00 (Nineteen Thousand Five Hundred Dollars and Zero Cents) for a total restated fee not to exceed $89,500.00 (Eighty-Nine Thousand Five Hundred Dollars and Zero Cents). The proposed project involves the excavation, installation and backfUing of approximately 2 miles of 18" diameter PVC water pipe,8"steel gas pipe and 4"PVC conduit by conventional trenching and 1.2 miles by horizontal directional drilling methods. PROJECT INFORMATION Based on our review of the project plans and specifications produced by Urban Engineering dated October 3,2013,we understand that the project wil consist of the following: • Installation of Utility lines to include: o 18"PVC water pipe o 8"Steel gas pipe o 4"PVC conduit SCOPE OF SERVICES The following scope of services is based,in part,on project plan and specification requirements, and is limited to providing testing and/or observations for the previously mentioned construction quantities. As such, we agree to provide a technician to provide the construction materials services as follows. We request that your construction representative provide us with a 24-hour notice for scheduling purposes. Hot Mix MohoMc Testing Kleideider will provide a technical professional, on a random basis, to sample asphalt from the jobsite.This task may include the following: • Perform random testing of the asphalt pavement for material evaluation to include extraction and gradation. • Prepare reports of tests. Cast-In-Place Concrete Perform testing during concrete placements,which will include: • Ambient and concrete temperature determinations • Entrained air content determination • Slump determination • Cast four inch by eight inch concrete test cylinders st the rate of 3/50 cubic yards of concrete or fraction thereof placed per day • Compressive strength determination of concrete test cylinders with one tested at 7 days and two tested at 28 days COMPENSATION While testing is dependent on the construction sequence, weather conditions, and the actual testing performed,we estimate a time and materials budget of$10,1 . The invoicing for this project will use the attached Schedule of Fees and the actual quantity of work performed. This amount will not be exceeded without prior approval. The City of Corpus Christi and Kleinfolder may subsequently agree in writing to provide for additional services to be rendered under this agreement for additional, negotiated compensation. Services provided by Klsinfelder will be consistent with the engineering standards prevailing at the time and in the area that the work is performed; no other warranty,express or implied,is intended, LIMITATIONS Our work will be performed in a manner consistent with that level of care and skill ordinarily exercised by other members of Kleinfilda's profession practicing g in the same locality, under similar conditions and at the date the services are provided, Our conclusions, opinions and recommendations will be based on a limited number of observation and data. It is possible that conditions could vary between or beyond the data evaluated. Kieinfeider makes no guarantee or warranty, express or implied, regarding the services, communication (oral or written),report,opinion,or instrument of service provided. The net cash amount of this invoice is payable on presentation of the invoice, If not paid within 30 days after the date of the invoice, the unpaid balance shall be subject to a FINANCE CHARGE of 1,5% per month, which is an ANNUAL PERCENTAGE RATE of 18%. 3, A one-hour minimum charge will be made for all field services, Technician lime for field services is billed portal-to-portal, in hourly increments following the minimum 1 hour, 4. Hours worked before 7 a.m./after 5 p.m. Monday through Friday and time worked in excess of 8 hours per day will be charged at 1.5 times the hourly rate: Additionally, weekend (Saturday and Sunday) and holiday work will be charged at 1,5 times the hourly rate. 5. Per Diem will be charged at a rate of $127 per day per person or expenses plus 15%, whichever is greater. Travel by vehicle will be charged at $0.85 per mile plus personnel time. Per Diem and travel will be charged for all projects in excess of 50 miles from the local Kleinfeider office. Travel expenses, such as airfare, will be charged at cost plus 15%. 8. Outside services will include a 15%markup unless otherwise noted. 7. We are protected by Worker's Compensation insurance (and/or Employer's Liability Insurance), and by Public Liability Insurance for bodily injury and property damage, and will furnish certificates thereof upon request. We assume the risk of damage to our own supplies and equipment. If your contract or purchase order places greater responsibilities upon us or requires further insurance coverage, we, specifically directed by you,will take out additional insurance(if procurable)to protect us at your expense, but we shall not be responsible for property damage from any cause, including fire and explosion,beyond the amounts of coverage of our insurance. 8.
