CITY OF CORPUS CHRISTI
AMENDMENT NO. 1
CONTRACT FOR PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "City", and Freese and Nichols, Inc. hereinafter called
"Engineer", agree to the following amendments to the Contract for Engineering Services for South Staples
Street from Brawner Parkway to Kostoryz Road (Project No. E12095) BOND 2012, as authorized and
administratively amended by:
Original Contract January 29, 2013 Motion No. M2013-017 $731,030.00
In the Original Contract, Exhibit "A", Section I. Scope of Services, Part A. Basic Services, Item No. 2.
Design Phase shall be added as set forth in the attached AMD No. 1, Exhibit "A."
In the Original Contract, Exhibit "A", Section I. Scope of Services, Part B. Additional Services, Item No. 3.
Topographic Survey and Item No. 6. Subsurface Utility Investigation shall be added as set forth in the
attached AMD No. 1 Exhibit "A".
In the Original Contract, Exhibit "A", Section III. Fees, Summary of Fees shall be modified and is attached
as AMD No. 1 Exhibit "A" for a fee not to exceed $49,537.00 (Forty Nine Thousand Five Hundred Thirty
Seven Dollars Zero Cents), for a total restated fee not to exceed $780,567.00 (Seven Hundred Eighty
Thousand Five Hundred Sixty Seven Dollars and Zero Cents). Monthly invoice will be submitted in
accordance with Exhibit "B".
All other terms and conditions of the January 29, 2013 contract between the City and Engineer, and of any
amendments to that contract, which are not specifically addressed herein shall remain in full force and
effect.

(City Project No. E12095)—Amendment#1
Dear Mr. Biles,
Freese and Nichols, Inc. (FNI) would respectfully request your consideration of our proposed
amendment#1 for South Staples Street from Brawner Parkway to Kostoryz Road (City Project No.
E12095). The amendment includes additional design services and coordination necessary for the storm
drainage improvements at Brawner Parkway. The amendment also includes ROW acquisition services
and a video inspection of an existing storm water trunk line within the project limits. FNI respectfully
requests a contract amendment in the amount of$49,537 to address the additional time and effort
required to support these project tasks.

1. Coordinate additional paving and drainage improvements at Brawner Parkway
and participate in additional meetings with the City and City's design consultant
2. Provide additional storm drainage design, utility coordination and pavement repair
design at Brawner Parkway

B. Additional Services.
Additional Services will include the following in addition to those items shown below:
2. ROW Acquisition
1. Provide ROW acquisition for two permanent easements adjacent to the Colony
Subdivision and two temporary construction easements
6. Subsurface Utility Investigation
1. Televise an estimated 4,500 linear feet of existing RCP storm water pipe ranging
in size from 18"to 54"
2. Provide related traffic control to facilitate the TV inspection for this pipe.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi,Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi,Texas either on a full or
part-time basis,but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self-employed
person,partnership,corporation,joint stock company,joint venture,receivership or trust,and
entities which for purposes of taxation are treated as non-profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
Judges of the City of Corpus Christi,Texas.
f. "Ownership Interest." Legal or equitable interest, whether actually or constructively held,
