Young, President, (ENGINEER), which agree as follows: 1. DECLARATIONS. "CITY" desires to engage "ENGINEER" to provide services in connection with City's project, described as follows: Runway 31-31 Extension/Displacement and Connecting Taxiways (Project No. E11047)"Project". 2. SCOPE OF WORK. "ENGINEER" shall provide services for the PROJECT in accordance with the accompanying Letters, Scope of Services, and Fee attached as"Exhibit A". 3. FEE. INDEXED EXHIBIT A CITY OF CORPUS CHRISTI,TEXAS Environmental Service Fees for the Environmental Mitigation of the Existing RWY 31 LOC Shelters for the Runway 13-31 Extension/Displacement and Connecting Taxiways Project at the Corpus Christi International Airport I. SCOPE OF SERVICES This proposal provides scope, schedule, and budget estimates for Environmental Service Fees for the Environmental Mitigation of the Existing RWY 31 LOC Shelters for the Runway 13-31 Extension/Displacement and Connecting Taxiways Project at the Corpus Christi International Airport. Proposed fees and information are provided in association with LNV, Inc. Environmental Services will be performed as described in the attached proposal by LNV, Inc. The Engineer shall provide the following services: A. SCOPE OF WORK 1. Coordinate with third party to perform a Hazardous Material Survey for the existing RWY 31 Localizer shelter and an adjacent metal shed, and document all sampling methods, collections, locations, quantities,and findings in one(1)final report. The Hazardous Material Survey report for each shelter shall include the following information. a. Asbestos-containing Materials(ACM); b. Lead-Based Paint; c. Mercury sources in miscellaneous materials, such as switches, gauges, and light bulbs; d. PCBs in electrical transformers(if owned by the FAA)and light ballasts; e. Lead-acid batteries; f. Pesticides; g. Potential radioactive materials, such as components of smoke and fire detection systems; h. General hazardous materials, such as general household chemicals,waste oils, and other materials located in the facility. 2. Follow the Hazardous Materials Survey requirements specified by the Client for each section listed above.The requirements specified by the Client are the following: a. Asbestos Inspection Requirements: The contractor shall collect three samples of each suspect-asbestos containing material identified at each shelter, such as roofing materials, vinyl floor tile, mastic, vinyl baseboard, wallboard, caulking, etc., utilizing AHERA protocols. Contract Personnel collecting asbestos bulk samples shall be currently licensed by the State of Texas as an asbestos building inspector. All ACM bulk sample analysis shall be completed by a NVLAP accredited laboratory and samples shall be analyzed using Polarized Light Microscopy (PLM). The contractor shall report all laboratory findings and make recommendations for future actions based on the results. The Client has specified: "Each final report shall clearly identify areas and materials that contain ACM, and shall contain pictures of all homogenous ACBMs identified. AMEND.NO.33 EXHIBIT A Page 1 of 4 KSA Engineers,Inc.Project No.CRP.035 Each final report shall also contain a copy of the Inspector's current Texas Asbestos Inspector license and a certificate of their most recent refresher training. A copy of the analytical laboratory's NVLAP certification and license from the State of Texas shall also be included in each final report." In this case these structures are considered commercial buildings, as they are not accessible by the general public, and need only be inspected by a person holding a current Inspector accreditation under the EPA's Model Accreditation Plan (MAP). This documentation will be included along with the laboratory's NVLAP certification information. Therefore the individual collecting the ACM bulk samples will not need to hold a license. b. Lead-Based Paint Sampling Requirements: All exterior and interior homogenous painted surfaces at each shelter shall be tested for lead-based paint. Contractor personnel collecting lead chip sample must be currently licensed by the State of Texas as a Lead Inspector. Each final report shall clearly identify areas and materials that contain lead-based paint, areas that contain damaged lead-based paint, and contain pictures of all homogenous lead-based paint identified. Typically FAA equipment shelters may have up to 4 homogenous painted areas per shelter. The Client has requested: "Each final report shall also contain a copy of the Inspector's current Texas Lead Inspector license and refresher training, as well as a copy of the laboratory's NVLAP certification and license from the State of Texas." The Texas Environmental Lead Reduction Rules(TELRR) require that all lead-based paint activities in target housing* and child-occupied facilities** be performed by certified individuals. Currently, Texas is one of about 39 states that offer certifications for persons conducting lead-based paint activities. Additionally, as a result of the joint U.S. Environmental Protection Agency(EPA)IU.S. Department of Housing and Urban Development(HUD)disclosure requirement of target housing effective September 6, 1996, for target housing greater than four dwelling units, and December 6, 1996, for target housing consisting of four or fewer dwelling units, individuals and/or firms engaged in lead-based paint activities in this housing should be certified. Furthermore, if an individual or company is based outside of Texas, they must become certified by Texas to do business in Texas. "Target housing - Any housing constructed prior to 1978, except housing for the elderly or persons with disabilities (unless any child who is six years of age or younger resides or is expected to reside in such housing) or any zero-bedroom dwelling. As defined in this section, target housing includes the terms residential dwelling, multi-family dwelling, and unit. "Child-occupied facility - A building or part of a building constructed before 1978, including, but not limited to, a day-care center, preschool, or kindergarten classroom. that is visited regularly by the same child, six years of age or younger, at least two days in any calendar week if the visits are for at least: (A) three hours each day; and (13) 60 hours each year. These facilities are considered to be neither Target Housing nor Child Occupied Facilities, therefore the individual collecting the suspect lead based paint samples will not need to hold a license. NVLAP certification information for the laboratory used will be included in the final report. AMEND.NO.33 EXHIBIT A Page 2 of 4 KSA Engineers,Inc.Project No.CRP.035 c. Mercury Survey Requirements: Each shelter shall be visually inspected for mercury. Quantities and locations of suspect materials identified during the survey, such as fluorescent light bulbs and thermostat switches,shall be identified in the final report. d. PCB Survey Requirements: Each shelter shall be visually inspected for suspect PCBs. If suspect PCB containing materials are identified during the survey, such as dielectric fluids in an FAA owned transformer, those materials should be sampled and tested for PCBs utilizing SW - 846 8082 methodology. Light ballasts, unless marked as PCB free,shall be assumed to contain PCBs. The contractor shall report all laboratory findings. Quantities and locations of all suspect and actual PCB containing materials identified during the survey should be noted in the final report. e. Lead-Acid Battery Survey Requirements: Each shelter shall be visually inspected for lead-acid batteries. Quantities and locations of lead acid batteries identified during the survey shall be identified in the final report. f. Pesticide Survey Requirements: Each Shelter shall be visually inspected for bulk pesticides. Quantities, types, and locations of bulk pesticides identified during the survey, if present, shall be noted in each final report. g. Radioactive Materials Survey Requirements: Each shelter shall be visually inspected for radioactive materials, such as smoke detectors and exit signs. Quantities, types, and locations of radioactive materials identified during the survey shall be noted in the final report. h. General Hazardous Materials Survey Requirements: Each shelter shall be visually inspected for general hazardous materials, such as common household chemicals and waste oil. Quantities, types, and locations of general hazardous materials identified during the survey shall be noted in each final report. 3. Request next day turnaround time from laboratory for any ACM and lead paint samples collected, and two day turnaround time for any suspect PCB samples collected. 4. The following is excluded from this scope of work, but if requested by the Client, may be performed by Provider for an additional cost: a. Provide cost estimate and recommendations for future disposal of any PCB containing materials, lead acid batteries, bulk pesticides, radioactive materials, and general hazardous materials identified during the survey. b. Classify waste based on analytical data and process knowledge. c. Coordinate with disposal facility and profile waste for approval to be accepted at disposal facility. d. Ensure proper labeling and manifesting of waste. e. Coordinate with disposal facility to schedule delivery of waste. f. SCHEDULE The Hazardous Material Survey and associated reporting shall be completed no later than July 25, 2014. Ill. FEES The Engineer proposes to provide the services of this contract for$16,190.00 on a lump sum basis. Note that this proposal is based on a lump sum fee for services to be performed by LNV and KSA's Environmental Planner, Molly Waller. No time has been programmed for KSA's Project Manager, Elliot Neph, or any other KSA employees. Any time required for coordination efforts by the Project Manager will not be charged to this specific contract, but will rather be charged to the associated Construction Administration Time&Materials contract(Amendment 30).
