Field note description of a triangular utility easement over and across a portion of Lot 5, Section 8, Bohemian Colony Lands, as shown on the map recorded in Volume A, Page 48, Map Records of Nueces County, Texas, which description is attached to and incorporated in this document as "Exhibit B" and depicted on the field notes location map attached to and incorporated in this document as "Exhibit C," the exhibits collectively being referred to and known as the "Premises 2." Together with the free ingress, egress, and regress to and for the Grantee, all for the purpose of erecting, constructing, installing, laying, replacing, servicing, repairing, using, maintaining, inspecting, reconstructing, modifying, removing, operating and keeping utility lines in, on, over, under, and along the Premises, including but not limited to water, wastewater, storm water, storm water detention, filtration, drainage, and gas, and together with all lines, pipes, conduits, and other equipment, improvements, and appurtenances used in the supply and provision of public utilities. TO HAVE AND TO HOLD, all and singular, the rights and privileges as described above to the Grantee, its successors, legal representatives, permitted assigns, and franchisees, for the proper and public use as a utility easement and for so long as used fnr ci irh ni irnnsPs and. if the use of said utility easement be ever abandoned, then, in 2014-388 rights and privileges shall cease. 8/18/14 Spear Consolidated Ltd INDEXED • These Correction Utility Easements are made as a correction to that certain Utility Easements dated July 8, 2014, and recorded in Doc # 2014025956, Official Public Records, Nueces County, Texas ("Corrected Easements"), to replace "Exhibit A","Exhibit B" and "Exhibit C" in their entirety to correct an error in the property description. "Exhibit A", "Exhibit B" and "Exhibit C" to these Correction Utility Easements correctly describes the Premises that were intended to be conveyed and should have been conveyed by the Corrected Easements. Other than this stated correction, this Correction Utility Easementsare intended to restate in all respects the Corrected Easements, and the effective date of this Correction Utility Easements relates back to the effective date of the Corrected Easements.
