TO THE
CDBG SUBRECIPIENT AGREEMENT
BETWEEN THE
CITY OF CORPUS CHRISTI
AND
MARY MCLEOD BETHUNE DAY NURSERY, INC
This first amendment ("First Amendment") is made by and between the City of Corpus
Christi ("City") and the Mary McLeod Bethune Day Nursery, Inc. ("Subrecipient").
WHEREAS, the City and the Subrecipient executed an agreement ("Agreement"),
which was approved by the City Council for the purpose of utilizing the City's FY2013-
14 Community Development Block Grant ("CDBG") Program funds;
WHEREAS, the Subrecipient has timely requested an extension of the construction
compliance and term dates in order to complete the project contemplated under the
Agreement; and
WHEREAS, the parties desire to execute this First Amendment to express their mutual
desire to reaffirm all terms, conditions, and covenants stated in the original Agreement
and to amend the original Agreement by extending the construction compliance date
from September 30, 2014 to June 30, 2015 and by extending the term date from
October 31, 2014 to July 31, 2015.
Section 1. By execution of this instrument, the parties agree to reaffirm and continue in
force all terms, conditions, and covenants stated in the original Agreement, as may be
amended by the execution of this First Amendment.
Section 2. Section 1 , subsection 1.1, of the Agreement is amended by deleting the
date "September 30, 2014" and inserting the date "June 30, 2015."
Section 3. Section 7, subsection 7.9, of the Agreement is amended by deleting the
date "September 30, 2014" and inserting the date "June 30, 2015."
Section 4. Section 9, subsection 9.1, of the Agreement is amended by deleting the
date "October 31, 2014" and inserting the date "July 31, 2015."
Section 5. Section 9, subsection 9.2, of the Agreement is amended by deleting the
date "September 30, 2014" and inserting the date "June 30, 2015."
Section 6. By execution of this First Amendment, the parties agree to revise and
extend the construction compliance and term dates stated in the original Agreement. All
other terms, conditions, and covenants of the Agreement not changed by this First
Amendment remain the same and in full force and effect.
