SCOPE OF WORK shall be modified by: The addition of Construction Administration Phase Services (Phase 1 — Trails) as specified in Exhibit "A" In the Original Contract, Section 5. FEE shall be modified by the attached Summary of Fees as shown in the attached Exhibit A-1 for an additional fee not to exceed $5,500.00 (in figures) Five Thousand Five Hundred Dollars and Zero Cents (in words) for a total restated fee not to exceed $1,039,499.00 (in figures) One Million Thirty Nine Thousand Four Hundred Ninety Nine Dollars and Zero Cents (in words). All other terms and conditions of the January 11, 2011 contract between the City and Consultant and of any amendments to that contract which are not specifically addressed herein shall remain in full force and effect. Client and Consultant have entered into that certain Agreement for Landscape Architectural Design Services for Oso Creek/ Oso Bay Area Park Master Plan dated as of January 11, 2011 (the "Original Agreement") and desire to amend the Original Agreement. B. Except as expressly modified by this Amendment, the Original Agreement remains unchanged and in full force and effect. II. AGREEMENT A. The parties agree that the SCOPE, of the Original Agreement, is hereby amended by adding the following: Additional Construction Contract Observation Services as requested by the City for Phase 1 Construction. B. The parties agree that the BASIC SERVICES, of the Original Agreement, is hereby amended by adding the following: 1. Construction Observation Services a. Additional site observation visits, reports and punch lists. b. Additional clarifications and coordination with Contractor and City. c. Reimbursable expenses. C. The parties agree that the COMPENSATION of the Original Agreement, is hereby amended by adding the following: 1. 1. Consultant's compensation shall include the total for AUSTIN/HOUSTON Basic Services (the "Basic Fee") and Additional Services performed on an hourly basis plus reimbursable expenses. Consultant's estimated compensation for Basic Services is set forth below. The amounts indicated do not include EXHIBIT"A" Page 1 of 2 • Amendment No. 9 June 26, 2014 Page 2 of 2 planning•landscape architecture amounts for Additional Services or resulting from substantial change in scope of the Project or services, but will otherwise not be exceeded without authorization from the Client. The Client agrees to pay the Consultant the following estimated maximum fees for the Basic Services. Fees for Basic Services: Construction Contract Observation $5,000.00 Reimbursables $500.00 III. APPROVED AND ACCEPTED This Amendment to Land Planning and/or Landscape Architectural Design Services Agreement is approved and accepted by the Client and Consultant upon both parties signing and dating the Amendment, and returning a signed copy to the Consultant. The effective date of the Amendment shall be the last date entered below.
