HomeMy WebLinkAboutC2014-426 - 11/5/2014 - NA AMENDMENT NO. 3 to CONTRACT FOR PROFESSIONAL SERVICES The City of Corpus Christi, Texas hereinafter called "CITY", and HDR Engineering, Inc. hereinafter called "ENGINEER," agree to the following amendment to the Contract for Professional Services for Seawall Repairs 2012 (Project No. E11090), as authorized and amended by: Original Contract for April 10, 2012 Motion M2012-071 $150,894.00 Professional Services Amendment No. 1 February 14, 2013 Administrative Approval $35,200.00 Amendment No. 2 April 9, 2014 Administrative Approval $2,555.00 Exhibit"A", SECTION 2. SCOPE OF SERVICES, PART A. BASIC SERVICES, ITEM NO. 3 BID PHASE AND ITEM NO. 4 CONSTRUCTION PHASE shall be amended as specified in Exhibit "A", attached. Exhibit "A", SECTION 2. SCOPE OF SERVICES, PART B. ADDITIONAL SERVICES, ITEM NO. 5 CONSTRUCTION OBSERVATION SERVICES shall be amended as specified in Exhibit "A", attached. In the original contract, EXHIBIT "A", SECTION 3. FEES, SUMMARY OF FEES shall be modified and is attached as Amendment No. 3 Exhibit "B" for a revised fee not to exceed $9,330.00 (Nine Thousand Three Hundred Thirty Dollars and Zero cents), for a total restated fee not to exceed $197,979.00 (One Hundred Ninety Seven Thousand Nine Hundred Seventy Nine Dollars and Zero cents). All other terms and conditions of April 10, 2012 contract between the City and Consultant will remain in full force and effect. We provided a Scope-of-Work adjustments letter on May 28, 2014 and received your e-mail of June 5, 2014 indicating that you had approved it and that you would process as soon as possible. We performed Construction Phase tasks (Engineering Services During Construction and Construction Observation) in accordance with the Scope-of-Work adjustments letter of May 28. On July 3, 2014 we provided an e-mail status of our Construction Phase tasks noting that the Contractor had gone beyond the originally scheduled 6-week time period and that there had been several iterations of Contractor submittals in order to obtain Contractor compliance with the contract documents. In that e-mail we also noted that our budget for Construction Phase services had nearly been depleted and that we would be sending another amendment request letter to cover the anticipated cost to complete our Construction Phase tasks. You informed us that the May 28, 2014 letter had not yet been processed and that we could simply edit that letter request and re-send it to you for processing. Those edits are included in the revised outline below: Referring to Exhibit"A" of the February 13, 2013 document,these scope-of-work adjustments are as follows: Exhibit"A"Page 2 of 5—"Bid Phase" Replace: • Replace the term "Small Construction Contract Bid Phase" with "Job Order Contract Negotiation Phase". Delete: • Delete Items 1 through 5. Add: 1. Assist the City with negotiations of two (2)Job Order Contractor proposals. 2. Participate in meetings with City staff and Contractors. 3. Assist the City in responding to contractor questions. 4. Project coordination and correspondence. 5. Exhibit"A" Page 3 of 5—"Construction Phase—Engineering Services During Construction" Replace: • Replace the sentence "The fee proposal for this task assumes 2012 rates and a 4-week construction period",with "The fee proposal for this task assumes 2014 rates and a 12-week construction period". Delete: • Delete Items 4,5,6 and 7. Modify: • Item 3 to read "The ALE will assist the City with responses to Contractor RFI5 that require an interpretation of associated technical issues. The City will be responsible for addressing minor RFIs and those RFIs that do not require a technical interpretation. The City will be responsible for processing any change orders that result from issues raised by Contractor RFIs." Schedule: • Pre-Construction Meeting May 8, 2013. Budget: • Amendment 1: $4,200+Amendment 3: $2,700=$6, 900 total. Exhibit"A" Pages 4&5 of 5—"Construction Phase—Construction Observation" Replace: • Replace the 15t sentence of the "NOTE" with "The fee proposal for this task assumes 2014 rates for an HDR representative to provide periodic construction observation during 'graveyard' shifts and as otherwise required during daytime shifts for a total not to exceed 12 hours." Delete: • Delete Item 2 in its entirety, which includes sub-items a through i. Schedule: • Graveyard shifts to begin May 19, 2014. • Daytime observation as required for remainder of budgeted time. Budget: • Amendment 1:$7,200 MINUS Amendment 3 ($5,000)=$2, 200 total.
