COUNTY OF NUECES §
THAT, DEL MAR COLLEGE ("GRANTOR") of 101 Baldwin Blvd., Corpus Christi,Nueces
County, Texas 78404,. in consideration of TEN DOLLARS ($10.00) and other good and valuable
consideration, paid by the CITY OF CORPUS CHRISTI, TEXAS ("GRANTEE") of 1201
Leopard Street, Corpus Christi, Nueces County, Texas 78401, the receipt of which is hereby
acknowledged, has granted,sold and conveyed,and does hereby grant,sell and convey to Grantee,a
Texas Home Rule municipal corporation, its successors and legal representatives, the free and
uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain
tract of land situated in Nueces County, Texas and being described as follows:
See the metes and bounds property descriptions attached and
incorporated as "Exhibit A" ("Premises") and maps showing the
location of the RIGHT-OF-WAY EASEMENT is attached and
incorporated as "Exhibit B" ("Premises").
Together with the free ingress,egress and regress to and for Grantee,and its franchisees,to construct,
operate,repair and maintain streets,sidewalks,curbs,gutters and appurtenances upon said Premises
for the public use by foot, with automobiles, carts, carriages and all other vehicles and all other
means of transportation necessary or convenient at all times and in all seasons in, along and upon
said Premises, as well as to lay, operate, inspect,replace,repair, service and maintain public utility
lines, storm sewers, and franchised utility lines in, on, over, under and along said Premises.
SPECIAL PROVISIONS
The right of way and easement and rights hereby granted are subject to all other easements,
exceptions, reservations, rights, and encumbrances of record or evidenced physically on the
Premises, and are granted without any warranty of title, express or implied, by Grantor.
Grantor hereby reserves for itself, its successors and assigns, the right to use the Premises for any
purpose and in any manner, so long as such use does not unreasonably interfere with the rights of
Grantee hereunder.
In addition, to the extent that the Premises contain one or more of Grantor's existing
pipelines/appurtenances, Grantee agrees that Grantee's rights hereunder are expressly subject to
Grantor's rights to use and operate such pipelines/appurtenances and replacements thereto.

successors,legal representatives,franchisees and the public,for the proper use as public streets and
utility easements for so long as used for such purposes,and if the use for said easements and rights of
way is ever abandoned, then the aforesaid rights and privileges cease.

The person signing this Right of Way Easement conveyance as Grantor, or signing on behalf of
the Grantor, represents, warrants, and guarantees that they are the Grantor or have the authority to
act on behalf of the Grantor for the purpose and consideration stated.

STATE OF TEXAS
COUNTY OF NUECES
Field Notes for a 0.001 Acre Tract of land out of Lot 3, Block C, Casa Linda Estates Unit 4, a
map of which is recorded in Volume 57,Page 53, Map Records of Nueces County, Texas; said 0.001 acre
tract being more fully described by metes and bounds as follows:
Beginning,at a 3/4 Inch Iron Pipe Found, on the Southeast Right-of-Way line of Kostoryz Road,
a 70 foot public road, being the West corner of Block B, Casa Linda Estates Unit 4, a map of which is
recorded in Volume 21, Page 44, of the said Map Records, for the North corner of the said Lot 3 and this
Tract;
Thence, South 36°52'50"East, with the Southwest line of the said Block B, the Northeast line of
the said Lot 3, 2.85 feet, to a 5/8 Inch Iron Rod, with red plastic cap stamped "URBAN ENGR C.C. TX.
set, for the East corner of this Tract, from whence a 5/8 Inch Iron Rod Found, for the East corner of the
said Lot 3 bears, South 36°52'50"East, 183.00 feet;
Thence, South 31°22'58" West, 43.46 feet, to a 5/8 Inch Iron Rod with red plastic cap stamped
"URBAN ENGR C.C. TX. set, on the common line of the said Southeast Right-of-Way and the
Northwest line of the said Lot 3, for the South corner of this Tract, from whence a 5/8 Inch Iron Rod
Found, for the West corner of the said Lot 3 bears, South 27°58'32"West, 171.23 feet;
Thence,North 27°58'32"East,with the said Common line, 44.60 feet,to the Point of Beginning,
containing 0.00 lAcres(58 Square Feet)of Land,more or less.
