AMENDMENT NO. 2
CONTRACT FOR PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "City", and HDR Engineering, Inc. hereinafter called
"Engineer", agree to the following amendments to the Contract for Professional Services for Cefe
Valenzuela Outfall Modifications & On-Call Consulting Services (Project No. E11050), as authorized
and administratively amended by:
Original Contract May 24, 2011 Administrative Approved $46,400.00
Amendment No. 1 July 30, 2013 Ordinance No. 029913 $69,800.00
In the original contract, Exhibit "A", Basic Services, Investigation & Design Phase shall be amended as
set forth in the attached AMD No. 2 Exhibit "A".
In the original contract, Exhibit "A", Summary of Fees shall be modified and is attached as AMD No. 2
Exhibit "A" for a fee not to exceed $14,400.00(Fourteen Thousand Four Hundred Dollars and Zero Cents),
for a total restated fee not to exceed $130,600.00 (One Hundred Thirty Thousand Six Hundred Dollars
and Zero Cents). Monthly invoice will be submitted in accordance with Exhibit "B".
All other terms and conditions of the May 24, 2011 contract between the City and Engineer, and of any
amendments to that contract, which are not specifically addressed herein shall remain in full force and
effect.

Dear Ms. Fudge,
This letter of September 29, 2014 is a follow-up to our letters of July 31, 2014, March 11, 2014 and August 19,
2014 in which we requested additional funds for performing work beyond the original scope-of-work for the
project. In a meeting with Grace Gonzalez on July 15, 2014, she requested that we provide additional
justification for the fees being requested. Therefore, the following paragraphs from the March 11, 2014 letter
have been expanded to provide the additional justification requested.
FIELD RECONNAISANCE/SURVEY
Early in the design phase, HDR unsuccessfully attempted to enlist the City's assistance in obtaining survey data
at the pipeline erosion site. HDR staff made out-of-scope efforts to perform additional site visits in order to
measure and document the data necessary to move the design phase forward.

Thus, the total impact to HDR's design phase project budget for field reconnaissance/survey effort and the
additional 100%submittal review responses is$14,400.
Since the 100% plans and associated review comments have been in the City's hands from the end of January
2014 through September 25, 2014; the original completion date of December 31, 2013 will need to be extended
to accommodate the additional scope-of-work,the City's hold on the 100% review, and a period of time for HDR
to regroup staff and respond to the City's 100%comments.
Therefore,should the City accept this proposed amendment to the project budget by October 17, we estimate
that the scheduled completion date for the Investigation and Design Phase should be re-established as
December 31,2014.
We hereby request your approval of an amended project budget that adds $14,400 to the Investigation and
Design Phase and an associated 12-month extension to the project schedule.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi, Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self-employed
person, partnership, corporation,joint stock company,joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non-profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
Judges of the City of Corpus Christi,Texas.
