AMENDMENT NO. 1
TO CONTRACT FOR
PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "CITY",and FREESE AND NICHOLS,INC., hereinafter
called "CONSULTANT", agree to the following amendment(s)to the Contract for Engineering Services for Ocean
Drive from Buford Street to Louisiana Avenue (Project No. E12093) Bond 2012, as authorized and
administratively amended by:
Original Contract January 29, 2013 Motion No. 2013-015 $855,969.00
In the original contract, Exhibit"A",Section I.Scope of Services, Part A. Basic Services shall be modified by
the addition of the following scope as shown on Exhibit "A":
Basic Services:
Design Phase
1. Prepare preliminary plans and draft exhibits to extend the project limit of Ocean Drive approximately
1,000 LF and include intersection improvements at Louisiana Ave. and Ocean Drive. Preliminary tasks
include preparation of exhibits for a roundabout intersection, evaluation of underground utilities and local
drainage improvements, and three (3) additional meetings with the City.
2. Provide storm drainage coordination for the future storm water improvements(Bond 2014)to be installed
at the intersection of Morgan Avenue and Ocean Drive. Design of the storm water line on Morgan Ave.
will be provided by others and incorporated into the Ocean Drive drawings. Conduct two (2) additional
meetings with City staff and consultants to coordinate planned improvements. Additional design of the
outfall to Corpus Christi Bay is not included in this scope.
In the original contract, Exhibit "A", Section I. Scope of Services, Part B. Additional Services shall be
modified by the addition of the following scope as shown on Exhibit"A":

Topographic Survey
1. Perform additional topographic survey to extend the project limits south and west of the Louisiana
intersection.
Subsurface Utility Investigation
2. Perform televising of existing storm drainage lines at the following locations:
a. Morgan Avenue—48" RCP Drop MH to Outfall (550 LF)
b. Ayers Street— 18" RCP Curb Inlet to Outfall (705 LF)
c. Cole Park— 18" Curb Inlet North to MH1 (560 LF)
d. Louisiana Area—72" RCP CI to Upstream and Downstream (200 LF)

In the original contract, Exhibit "A", Section III. Fees shall be modified as shown for a fee not to exceed
$49,994.00(Forty Nine Thousand, Nine Hundred Ninety Four Dollars and Zero Cents)for a total restated fee not to
exceed$905,963.00(Nine Hundred Five Thousand, Nine Hundred Sixty Three Dollars and Zero Cents). Summary

Dear Ms. Fudge,
Freese and Nichols, Inc. (FNI)would respectfully request your consideration of our revised amendment
tf1 for Ocean Drive–Louisiana Ave.to Buford St. (City Project No. E12093). The amendment includes
basic and additional services requested by the City to extend the project limits approximately 1,000'and
include the preliminary design of the Louisiana Avenue intersection,coordination of the Bond 2014
storm drainage design improvements at Morgan Ave.and Ocean Drive, and additional investigation of
the storm water outfalls at Morgan,Ayers, and Cole Park to support the Bond 2014 projects. FNI
respectfully requests a contract amendment in the amount of$49,994 to address the additional time
and effort required to support these project tasks.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi,Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi,Texas either on a full or
part-time basis,but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self-employed
person,partnership,corporation,joint stock company,joint venture,receivership or trust,and
entities which for purposes of taxation are treated as non-profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
