HomeMy WebLinkAboutC2015-121 - 1/20/2015 - NA CITY OF CORPUS CHRISTI AMENDMENT NO. 2 CONTRACT FOR PROFESSIONAL SERVICES The City of Corpus Christi, Texas, hereinafter called "CITY," and RVE, INC., hereinafter called "Engineer", agree to the following amendment to the Contract for Engineering Services for Williams Drive Improvements Phase 3 from Staples Street to Airline Road (Project No. E11116) BOND ISSUE 2012),as authorized and administratively amended by: Original Contract February 21, 2012 Motion No. M2012-038 $959,995.00 Amendment No. 1 October 15, 2013 Administrative Approval $3,000.00 In the Original Contract, Exhibit "A", Section 1. Scope of Services, Part A. Basic Services shall be amended as set forth in the attached Amendment No. 2, Exhibit "A" and as follows: REMOVE: Paragraph e. under Item 3. Bid Phase. In the Original Contract, Exhibit "A", Section 1. Scope of Services, Part B. Additional Services, Line Item No. 7 Construction Observation Services shall be reduced as set forth in the attached Amendment No. 2, Exhibit "A". In the Original Contract, Exhibit "A", Section 1. Scope of Services, Part B. Additional Services shall be amended to include Item No.. 13 Revise Construction Documents to Provide for Project Alternatives as set forth in the attached Amendment No. 2, Exhibit "A" and as follows: RVE will perform the following revisions to the construction documents: - Revise plans and contract documents to add Alternate No. 1: HMAC pavement and concrete bus pads, including revisions to related details; - Revise plans and contract documents to add Alternate No. 2: Additional wastewater infrastructure improvements outside of proposed pavement pending availability of funds; - Revise the temporary pavement design and details for use over utility trenches; - Revise project quantities; - Revise TxDOT quantities; - Revise Opinion of Probable Cost; - Revise Bid Proposal Form; and - Prepare new Bid Package and submit to City once for review followed by a sealed Bid Package incorporating any revisions resulting from the review process. CONDITIONS: - The scope of work of this Contract Amendment is contingent upon using the "old" City and TxDOT Contract Documents and Specifications. Converting to "new" City and TxDOT Contract Documents and Specifications is not included in this Contract Amendment. - Revisions to the Construction Documents other than those listed above are not included in the scope of work of this Contract Amendment. - Revisions to the Final Engineering Letter Report (FELR) are not included in the scope of work of this Contract Amendment. - Based upon the unit prices of the recent Low Bidder on the project, RVE estimates that the above mentioned revisions to the Construction Documents may result in a Total Project Construction Cost reduction of approximately $700,000; however, due to the uncertain nature of the public bidding process, RVE cannot guarantee the outcome of 2015-121 Is- 1/20/15 AMD.NO.2 Page 1 of 2 RYE Inc. Additional Services shall be amended to include Item No. 14 Re-Bid Phase as set forth in the attached Amendment No. 2, Exhibit "A" and as follows: During the Re-Bid Process, RVE will perform the Bid Phase Basic Services as listed in the original AE Contract under Exhibit "A", Section 1. Scope of Services, Part A. Basic Services, 3. Bid Phase, Items a. thru d. Item e. is considered Null and Void with this Contract Amendment. In the Original Contract, Exhibit "A", Section 3. Fees, Part C. Summary of Fees shall be amended as specified in the attached Amendment No. 2, Exhibit "A" Summary of Fees for a fee not to exceed $0.00 (Zero Dollars and Zero Cents), for a total restated fee not to exceed $962,995.00 (Nine Hundred Sixty-Two Thousand Nine Hundred Ninety-Five Dollars and Zero Cents). Monthly invoice will be submitted in accordance with Exhibit "B". All other terms and conditions of the February 21, 2012 contract between the City and Engineer, and of any amendments to that contract, which are not specifically addressed herein shall remain in full force and effect. Acting Director of Capital Programs Re: Williams Drive Phase 3 -Project No.El 1116 Contract Amendment No.2—Revisions to Construction Documents to Add Project Alternates and Re-Bid Project Dear Ms.Fudge: As requested, we are submitting Contract Amendment No. 2 (CA2) to our Williams Drive Phase 3 A/E Contract. The purpose of CA2 is to revise and re-bid the construction documents in hopes of arriving at a lower construction cost that better accomplishes the City's financial goals. CA2 includes the addition of pavement and wastewater alternates to the Project, which will allow the City to choose the most economical type of pavement (concrete or HMAC) and to choose additional wastewater improvements, if funds are available. CA2 includes the necessary revisions to the construction documents, preparation and processing of a new bid package, and re-bidding services. CA2 is contingent upon a limited scope of revisions, use of the "old" City and TxDOT Contract Documents and Specifications and no revisions to the Final Engineering Letter Report as detailed further on the attached A/E Contract Amendment No. 2. The total engineering fee for CA2 is$87,780. With the original A/E Contract, the City Council approved$249,600 for Construction Observation Services for the Project;however,this Additional Service Line Item has never been authorized. RVE proposes to reduce that fee by $87,780 in order that CA2 will be a zero-dollar change to the current A/E Contract. Another Contract Amendment will be required in the future in order to provide sufficient funds for Construction Phase and Construction Observation Services.
