Palm Land Investments, Inc., a Texas Corporation, Dan Caballero, President
("Grantor"), whose address is 5949 La Costa, Corpus Christi, Texas 78414, for and in
consideration of the sum of One and No/100 Dollar ($1.00) paid by the City of Corpus
Christi, a Texas home-rule municipal corporation ("Grantee"), whose address is 1201
Leopard Street, Corpus Christi, Texas, 78401, the receipt of which is acknowledged,
has granted, sold, and conveyed and by these presents does grant, sell, and convey to
the Grantee, its successors, legal representatives, permitted assigns and franchisees,
the free and uninterrupted use, liberty, privilege, and easement of going in, on, over,
under, and along a certain tract of land situated in Nueces County, Texas, and being
described as follows:
See the metes and bounds property description for (1) Temporary Right-of-
way out of Lot 10, Section 26, Flour Bluff and Encinal Farm and Garden
Tracts, a map of which is recorded in Volume A, Pages 41-43, Map Records
of Nueces County, Texas, which description is attached to and incorporated
in this document as "Exhibit A" and depicted on the field notes location
map attached to and incorporated in this document as "Exhibit B," the
exhibits collectively being referred to and known as the "Premises."

Texas, and its franchisees, to construct, operate, repair and maintain streets, sidewalks,
curbs, gutters and appurtenances upon said Premises for the public use by foot, with
automobiles, carts, carriages and all other vehicles and all other means of transportation
necessary or convenient at all times and in all seasons in, along and upon said Premises,
as well as for the purpose of erecting, constructing, installing, laying, replacing, servicing,
repairing, using, maintaining, inspecting, reconstructing, modifying, removing, operating
and keeping utility lines in, over, under, on and along the premises. (including but not limited
to water, wastewater, storm water, storm water detention, filtration, drainage and gas,
together with all lines, pipes, conduits and other equipment, improvements and
appurtenances used in the supply and provision of public utilities.)
TO HAVE AND TO HOLD, all and singular, the rights and privileges as describe above to
the City of Corpus Christi, Texas, its successors, legal representatives, permitted assigns,
and franchisees, for the proper use as a temporary right-of-way and, for so long as used for
such purposes, and if the use of said easement be ever abandoned, then, in that event, the
aforesaid rights and privileges shall cease.

BEING 0.2554 acre (11,126 square feet) of land situated in Lot 10, Section 26 of the Flour
Bluff& Encinal Farm and Garden Tracts as recorded in Volume A. Pages 41 through 43 of
the Map Records of Nueces County, Texas, said 0.1751 acre of land conveyed to Palm
Land Investment, Inc. by L and L Family Partnership, Ltd. by Correction Special Warranty
Deed, Document No. 2012011143, dated February 20, 2012 and recorded in the Official
Records of Nueces County, Texas, said 0.2554 acre of land being more fully described by
metes and bounds as follows: All bearings based on the Texas Plane Coordinate System,
South Zone.
COMMENCING at an existing 5/8 inch iron rod in the common line of said L and L
Family Partnership, Ltd. and the southeast line of South Fork Unit 5 (Amending Plat) as
