AMENDMENT NO. 2
CONTRACT FOR PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "City", and ECMS, LLC. (Engineering & Construction
Management Services, LLC.) hereinafter called "Engineer", agree to the following amendments to the
Contract for Engineering Services for Lifecycle Curb and Gutter Improvements (Project No. E12143), as
authorized and administratively amended by:
Original Contract May 21, 2013 Motion No. M2013-087 $73,150.00
Amendment No. 1 September 24, 2014 Administrative Approval $17,500.00
In the Original Contract, Exhibit "A", Section I. Scope of Services, Part A. Basic Services shall be amended to
include additional Item No. 2 Design Phase services and Item No. 3 Bid Phase services as set forth in the
attached AMD No. 2, Exhibit "A".
In the Original Contract, Exhibit "A", Section III. Fees, Summary of Fees shall be modified and is attached as
AMD No. 2 Exhibit "A" for a fee not to exceed $3,000.00 (Three Thousand Dollars and Zero Cents), for a
total restated fee not to exceed $93,650.00 (Ninety Three Thousand Six Hundred Fifty Dollars and Zero
Cents). Monthly invoice will be submitted in accordance with Exhibit "B".
All other terms and conditions of the May 21, 2013 contract between the City and Engineer, and of any
amendments to that contract, which are not specifically addressed herein shall remain in full force and effect.

This is a request for Amendment No. 2 to my AE contract, design, E12143, Lifecycle Curb&Gutter
Replacement,to increase the contract amount by$3,000, for a new total of$93,650.
Amendment#1 for the design of the new bid package was awarded on September 24, 2014 in the
amount of$17,500 for a total contract amount of$90,650..
After the 90% review of the bid package, I was directed not to use the CCR 00 and 01 documents, but to
use the Old Special Provisions and the Old General Provisions(Blue pages), and to incorporate certain
revisions which would affect the new digital bidding process, plus other items of concern to Legal
Counsel. Also,changes were made to the drawings which were not part of the previous requirements.
The front end documents were redone, and the drawings were edited and corrected, which required
only about 20%more effort, since much of the work was done on the IDIQ Minor Pavement
Improvements project. The agreed upon fee for the design/bid-package preparation portion in the
Amendment#1 is$15,000.
The additional fee requested is calculated as 20%of$15,000= $3,000.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi,Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi,Texas either on a full or
part-time basis,but not as an independent contractor.
d. "Finn." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self-employed
person, partnership,corporation,joint stock company,joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non-profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
