CONTRACT FOR PROFESSIONAL SERVICES
AMENDMENT NO. 1
The City of Corpus Christi, Texas hereinafter called "CITY", and Freese and Nichols, Inc. hereinafter
called "ENGINEER" agree to the following amendment to the Contract for Professional Services for
Choke Can on Dam S'illwa Gate Rehabilitation Pro'ect No. E14043 , as authorized and amended
by:
Original NE Agreement October 21, 2014 Ordinance No. 030318 $381,220.00
Exhibit "A" shall be amended to include inspection and recommendations for rehabilitation of a
damaged stem on an outlet tower sluice gate as well as design of stem repair plans and construction
notes to support a Request for Change Proposal as shown on the attached Amendment No. 1 Exhibit
Exhibit "A" shall be amended as specified in Amendment No. 1 Exhibit "A" for a revised fee not to
exceed $19,652.00 (Nineteen Thousand Six Hundred Fifty-Two Dollars and Zero Cents), for a total
restated fee not to exceed $400,872.00 (Four Hundred Thousand Eight Hundred Seventy-Two
Dollars and Zero Cents). Monthly invoices shall be submitted in accordance with Exhibit "B".
All other terms and conditions of the October 21, 2014 contract between the City and Engineer, and any
amendments to that contract, which are not specifically addressed herein shall remain in full force and
effect.

Choke Canyon Dam Spillway Gate Rehabilitation
Amendment No. 1 •
Project No. E14043
Project Description and Task List:
The City is currently undertaking the Choke Canyon Dam Spillway Gate
Rehabilitation Project. In addition to re-coating of the spillway gates as required
by the contract documents, the City has determined that repairs to a broken
sluice gate stem are required for proper control of water releases. FNI has been
asked by the City to inspect the damaged stem on the outlet tower and to
prepare drawings and develop technical notes to replace the gate stem in-kind or
as recommended by gate manufacturer via a change order to the Choke Canyon
Dam Spillway Gate Rehabilitation Project. FNI shall prepare drawings and
technical notes as part of a Request for a Change Proposal (RCP) for the
construction contractor.
Scope of Services:
1. Preliminary Phase
• NA
2. Design Phase
Pre-Final Design
• Review existing drawings, past inspection reports, and other city documents
and perform one (1) site visit to Choke Canyon Dam to observe damaged
stem at outlet tower.
• Develop and submit for review the Pre-Final set of drawings and technical
notes as part of a Request for a Change Proposal (RCP) to repair the
damaged stem. The RCP shall be prepared in accordance with the existing
construction contract documents. The project drawings must comply with the
City of Corpus Christi Plan Preparation Standards.
• Develop opinion of probable construction cost(OPCC).
• Furnish one (1) set of the RCP including Pre-Final drawings, technical notes,
and OPCC to the City of Corpus Christi for review and comment. The City
shall assume cost for reproduction of additional sets.
• Upon receipt of City Comments, proceed to next phase by assimilating all
review comments, modifications, and additions/deletions as necessary.
Final Design
• Complete and submit the complete Final set of RCP documents including
drawings, technical notes, revised OPCC, and transmittal form in accordance

with the City of Corpus Christi's preferred standard format and Choke Canyon •
Dam Spillway Gate Rehabilitation Project construction contract documents.
• Furnish the City with both a hardcopy of the RCP including drawings and
technical notes, as well as the full documents in electronic format.

• Assist the City in obtaining and reviewing Change Proposal by construction
Contractor of the Choke Canyon Dam Spillway Gate Rehabilitation Project.
• Upon City approval, assist City in issuance of a Change Order for execution
by the Contractor and the City.
5. Additional Services (Not Included as part of the scope of this Exhibit)
• Stem failure mode analysis
• Underwater inspection
• Material testing and analysis
Project Schedule: The following schedule is proposed based on a notice to proceed
of July 151h, 2015.

Fees:
A. Fees for A/E services include:
• The necessary conferences and site visit for the preparation and execution of
the phases outlined herein.

accordance with the City format per the Choke Canyon Dam Spillway Gate
Rehabilitation Project construction documents.
B. City of Corpus Christi Shall Supply or Reimburse the Following:
• All available base and/or site maps from City Engineering files
• Existing city utility layouts (water,wastewater,gas and drainage)
• Approval of final designs and drawings
• All fees for reviews and/or inspections from Regulatory Agencies
• All printing and reproduction cost[through City approved vendor]

DEFINITIONS

Council of the City of Corpus Christi,Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to have an 1
effect on that interest that is distinguishable from its effect on members of the public in general or a

c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part-
