HomeMy WebLinkAboutC2015-246 - 8/15/2015 - NA SMALL A/E AGREEMENT for Architect/Engineer Consultant Services This AGREEMENT is between the City of Corpus Christi,Texas, a Texas home-rule municipal corporation, "CITY", acting through its duly authorized City Manager or designee("CITY ENGINEER"), and LNV, Inc., a Texas corporation, acting through its duly authorized representative who is Dan S. Leyendecker, P. E., President "ENGINEER", which agree as follows: 1. DECLARATIONS. "CITY" desires to engage "ENGINEER" to provide services in connection with City's project, described as follows: Street and Solid Waste Administration Building Floor Settlement and Electrical Transfer Switch Replacement(Project No. E15094) "PROJECT". 2. SCOPE OF WORK. "ENGINEER"shall provide services for the"PROJECT"in accordance with the accompanying Letter, Scope of Services, and Fee attached as Exhibit"A". 3. FEE. The"CITY"agrees to pay the"ENGINEER"for services provided in accordance with Exhibit "A", Scope of Services, and Fee under this AGREEMENT, a total fee not to exceed$11,030.00(in figures), (Eleven Thousand Thirty Dollars and Zero Cents) (in words). Monthly invoices will be submitted in accordance with Exhibit "B". 4. INDEMNIFICATION AND HOLD HARMLESS. The "ENGINEER" agrees to indemnify, save harmless and defend the "CITY", and it's agents, servants, and employees as more fully set forth in Exhibit"C". 5. OWNERSHIP OF DOCUMENTS. All documents including contract documents (plans and specifications), record drawings, contractor's field data and submittal data will be the sole property of the City and may not be used again by the Engineer without the express terms written consent of the Director of Capital Programs. All work to be performed will be in accordance with all City of Corpus Christi building code requirements. LNV shall perform said service and all acts attendant thereto with a reasonable standard of care. The following Items listed below shall be provided by the City of Corpus Christi: • All drawings and related documents for the existing Street and Solid Waste Department Office Building LNV has prepared the following scope of work: Basic Eneineerina Services: Structural Enaineerino Services: 1. Study existing drawings to understand the existing design and construction of the structure and foundation system. 2. Study existing geotechnical report used for original design of structure foundation system, if available. 3. Meet with necessary City personnel to gain history and better understanding of the timeframe for the settlement being reported and any previous plumbing leaks and repairs. 4. Perform an on-site visual assessment of the structure to obtain field information for proper assessment, including floor elevations. 5. Coordinate with plumber and electrical engineer to perform required on-site tests and observations. 6. Prepare a'Draft`letter report Indicating our means and methods of our assessment,findings, professional opinions,and recommendations,including electrical engineering and plumbing investigation. 7. Prepare preliminary engineer's estimate of probable repair costs for each option recommended in the draft report. 8. Prepare necessary drawings/exhibits as required to clarify the report. 9. Meet with City personnel as required to discuss draft report and path forward. 11. Pick up final comments from City and submft three(3)reports sealed by a Texas Registered Professional Engineer and electronic file of complete report. Electrical Enaineerina Services: 1. Coordinate with Electrical Engineer for the design of electrical systems to include electrical code compliance,observe current existing emergency generator transfer switch,coordinate with transfer switch equipment suppliers to verify switch capacity for continued usage,and determination of available replacement parts. Plumbing investigation Services: 1. Coordinate with plumber to perform a visual inspection on all plumbing drains under the suspended structure. 2. Coordinate with plumber to perform complete static isolation test on the drain system below the slab-on- grade portion of the foundation. LNV proposes to perform the above-listed Scope of Work for the following lump sum fees. This Indemnification does not apply to any liability resulting from the negligent acts or omissions of the City of Corpus Christi or its employees, to the extent of such negligence. Consultant must, at City's option, defend Indemnitee and with counsel satisfactory to the City Attorney. Consultant must advise City in writing within 24 hours of any claim or demand against City or Consultant known to Consultant related to or arising out of Consultant's activities under this Agreement.
