HomeMy WebLinkAboutC2015-252 - 8/21/2015 - NA e t AMENDMENT NO. 1 to CONTRACT for Architect/Engineer Consultant Services This AGREEMENT is between the City of Corpus Christi, Texas, a Texas home-rule municipal corporation, "CITY", acting through its duly authorized City Manager or designee("CITY ENGINEER"),and Russ Berger Design Group, Inc., a Texas corporation, acting through its duly authorized representative who is Russ Berger, FASA, President"CONSULTANT", which agree as follows: 1. DECLARATIONS."CITY"desires to engage"CONSULTANT"to provide services in connection with City's project, described as follows: City of Corpus Christi Municipal Communication Studio Facility Renovation (Project No. El 3144) "PROJECT". 2. SCOPE OF WORK. "CONSULTANT"shall provide services for the"PROJECT"in accordance with the accompanying Letter, Scope of Services, and Fee attached as Exhibit"A". 3. FEE. The "CITY" agrees to pay the "CONSULTANT" for services provided in accordance with Exhibit "A", Scope of Services, and Fee under this CONTRACT, a total fee not to exceed $6,900.00 (in figures), (Six Thousand Nine Hundred Dollars and Zero Cents) (in words), for a total re-stated fee not to exceed $66,200.00(in figures), (Sixty Six Thousand Two Hundred Dollars and Zero Cents)(in words). Monthly invoices will be submitted in accordance with Exhibit"B". 4. INDEMNIFICATION AND HOLD HARMLESS. The "CONSULTANT" agrees to indemnify, save harmless and defend the "CITY", and it's agents, servants, and employees as more fully set forth in Exhibit"C". 5. OWNERSHIP OF DOCUMENTS. All documents including contract documents (plans and specifications), record drawings, contractor's field data and submittal data will be the sole property of the City and may not be used again by the Consultant without the express terms written consent of the Director of Capital Programs. We have based the proposed scope on our meeting and telephone conversations with Preeti Shrestha and the supplemental tour of 1201 Leopard Street optional sixth floor locations on August 29, 2014. This amendment is an extension of the existing proposal dated May 9, 2014 and shall supplement the scope and services outlined therein. Following our telephone conversation with Daniel Deng, the City has requested we supplement this Amendment and include Review and Inspection Fees associated with the project accessibility (TAS). In addition, this amendment also covers re-issuance of the final bid documents previously submitted on June 26, 2015. The re-issuance was necessary to address additional comments received from the City and to edit updated front-end documents. SCOPE OF PROJECT 4006 BELT LINE RD The scope of this amendment is divided into four parts — A project rendering, an SUITE 160 additional site review and plan studies for optional locations of the new facility, ADDISON review and inspection fee for TAS review, and final document re-issuance. The rendering will depict the front entrance of the new space to provide the overall concept and appearance of the new facility. The rendering will generally show the material colors and finishes selected during the course of design development. Due to the structural and infrastructure limitations — specifically the conflict with an existing storm line passing through the proposed studio space — outlined in our initial proposal and discovered during our walk-through on July 23rd, the City requested the design team examine optional locations within 1201 Leopard Street for the new facility, including space on the sixth floor as well as space on the basement level adjacent to the currently proposed location. The design team generated plan options for locations on the basement level. The initial proposal for Project E13144 identified fees associated with review and inspection fees as reimbursable expenses. Following discussion with Daniel Deng, the city requested for this Amendment to include fees for review and inspection related to accessibility. These fees are included as a direct pass- through of fees dictated by Texas Department of Licensing and Regulation (TDLR). The project was finalized on January 23, 2015 — and was prepared for bidding on June 26, 2015. The City provided additional comments on June 26, 2015 and the City decided to forgo the issuance of the documents to allow the design team to address these updates. The comments included revisions to the front-end specifications, re-dating the documents, and re-printing and re-submission of the documents. DESCRIPTION OF SERVICES RENDERING The rendering will be prepared utilizing either three-dimensional modeling software equivalent to Sketch-up, or prepared manually using an artistic media. The rendering will provide one interior image to provide a general concept of the materials and appearances proposed for the project. The rendering will reflect a generally realistic view, but is not intended to be photo-realistic. The rendering will be provided electronically to the City for their use. The overall size of the rendering will be formatted to fit approximately an 18"x24" canvas. The rendering will be developed over the course of the design, with the final product available following the completion of the construction documents and prior to acceptance of bids. AMEND. NO. 1 EXHIBIT "A" Page 2 of 5 . mu Valerie Gray, P.E. - 3 - October 3, 2014 Revised December 1, 2014 Revised July 16, 2015 ■ LOCATION AND SPACE PLAN STUDIES Following our walk-through on July 23, 2014 and the supplemental report issued on August 7, 2014, the Design Team was requested to visit 1201 Leopard to examine other potential locations for the new facility. Russ Berger and Clint Ashworth attended a meeting on August 29, 2014 where optional locations were explored. The team determined that two additional plan study options were necessary to evaluate optional possibilities. The design team prepared these two options and submitted the plans to the city. TAS REVIEW AND INSPECTION FEES TAS Review and Inspection fees are dictated by TDLR. Clarence Upchurch (RAS #47) with Total Design Four— located in Corpus Christi —was enlisted to perform the Review. Fee also includes the cost for registering the project that are also dictated by the TDLR. The project is registered under EABPRJ5818835. BIDDING DOCUMENT RE-ISSUANCE Front End specifications will be re-edited and sections replaced to accommodate comments received from the City on June 26, 2015. All Drawings documents and specifications will be re-dated in accordance with the date received from the City (Date to be determined). A line item allowance will be added to the OPCC to accommodate the City requested Allowance for equipment. . COMPENSATION Additional compensation for the above services is warranted. The fees stipulated below are based on our current hourly rates outlined below. Additional reimbursable travel expenses will be billed in accordance with our original proposal. This Indemnification does not apply to any liability resulting from the negligent acts or omissions of the City of Corpus Christi or its employees, to the extent of such negligence. Consultant must, at City's option, defend Indemnitee and with counsel satisfactory to the City Attorney. Consultant must advise City in writing within 24 hours of any claim or demand against City or Consultant known to Consultant related to or arising out of Consultant's activities under this Agreement.
