HomeMy WebLinkAboutC2015-258 - 8/31/2015 - NA AMENDMENT NO. 2 TO CONTRACT FOR PROFESSIONAL SERVICES The City of Corpus Christi, Texas, hereinafter called "CITY", and Chuck Anastos Associates, LLC hereinafter called"ARCHITECT", agree to the following amendments to the contract for Architect/Engineer Consultant Services for the following project, as authorized and administratively amended by: Contract for Professional Services March 26, 2013 Motion No. M2013-055 $87,300.00 Amendment No. 1 January 17, 2014 Administrative Approval $11,000.00 1. DECLARATIONS."CITY"desires to engage"ARCHITECT"to provide services in connection with City's project, described as follows: Animal Control Remodel/Improvements (Project No. E12111) BOND ISSUE 2012 ("PROJECT"). 2. SCOPE OF WORK. "ARCHITECT" shall provide services for the "PROJECT" in accordance with the accompanying Letter, Scope of Services, and Fee attached as "Exhibit A". Additional Construction Phase Services and Construction Observation Services. 3. FEE. The"CITY"agrees to pay the"ARCHITECT"for services provided in accordance with Exhibit"A", Scope of Services, and Fee under this AGREEMENT, a total fee not to exceed $20,000.00 (Twenty Thousand Dollars and Zero Cents) for a total restated fee not to exceed $118,300.00 (One Hundred Eighteen Thousand Three Hundred Dollars and Zero Cents). Monthly invoices will be submitted in accordance with "Exhibit C". 4. INDEMNIFICATION AND HOLD HARMLESS. The Architect agrees to indemnify, save harmless and defend the City of Corpus Christi, and its agents, servants and employees as more full set forth in Exhibit"B". 5. OWNERSHIP OF DOCUMENTS. All documents including contract documents (plans and specifications), record drawings, contractor's field data and submittal data will be the sole property of the City and may not be used again by the Architect without the express terms written consent of the Direc - f Capital Programs. We are requesting this increase of our fee for the following reason(s): 1. Original Construction Phase services were lowered from $10,800 to $7,800; and Supplemental Engineering 1 Construction Observation fee of $16,000 was removed completely. I explained the importance of NE review of submittals and shop drawings and at least bi-weekly site visits during construction to observe the progress of the contractor. I was instructed to include only one (1)- site visit per month to observe construction and approve applications for payment. All other site visits would be at request of Owner ony and for additional compensation. Review of submittals and shop drawings by Owner's Construction office,not the project architect. 2. Construction Phase hours spent jo date: A. Review of shop drawings and submittals by NE team: 77 hours B. This Indemnification does not apply to any liability resulting from the negligent acts or omissions of the City of Corpus Christi or its employees, to the extent of such negligence. Consultant must, at City's option, defend Indemnitee and with counsel satisfactory to the City Attorney. Consultant must advise City in writing within 24 hours of any claim or demand against City or Consultant known to Consultant related to or arising out of Consultant's activities under this Agreement.
