CITY OF CORPUS CHRISITI
CONTRACT FOR PROFESSIONAL SERVICES
This AGREEMENT is between the City of Corpus Christi, Texas, a Texas home-rule
municipal corporation, "CITY", acting through its duly authorized City Manager or designee ("City
Engineer"), and LNV, Inc., a Delaware corporation,acting through its duly authorized representative
who is Dan S. Levendecker, P.E., President(ENGINEER), which agree as follows:
1. DECLARATIONS. "CITY" desires to engage "ENGINEER" to provide services in
connection with City's project,described as follows:Corpus Christi Water System Pressure Zone
Boundary(Project No. E151741"Project".
2. SCOPE OF WORK. "ENGINEER" shall provide services for the PROJECT in
accordance with the accompanying Letter, Scope of Services, and Fee attached as Exhibit"A".
3. FEE. The "CITY" agrees to pay the "ENGINEER" for services provided in
accordance with Exhibit"A", Scope of Services, and Fee under this AGREEMENT, a total fee not to
exceed $44,570.00, (Forty-Four Thousand Five Hundred Seventy Dollars and Zero Cents).
Monthly invoices shall be submitted in accordance with Exhibit"B".
4. INDEMNIFICATION AND HOLD HARMLESS. The "ENGINEER" agrees to
indemnify, save harmless and defend the"CITY", and it's agents, servants,and employees as more
fully set forth in Exhibit "C".
5. OWNERSHIP OF DOCUMENTS. All documents including contract documents
(plans and specifications), record drawings, contractor's field data and submittal data will be the sole
property of the City and may not be used again by the Engineer without the express terms written
consent of the Director Capital Programs. However,the Engineer may use standard details that are
not specific to this project.

Dear Mr. Edmonds:
Please accept this letter as our formal proposal for professional services associated with the
Water System Pressure Zone Boundary project for the City of Corpus Christi water distribution
system. LNV hereby agrees to perform the following Engineering services:
Project Background:
On Thursday, July 23, 2015, the City of Corpus Christi issued a mandatory water boil notice
after water samples in Flour Bluff tested positive for E. Coli. The water boil advisory extended
into the weekend until it was lifted Saturday evening (July 25, 2015). While the contaminated
samples were discovered in the Flour Bluff area, the structure of the water distribution system
required that the entire city be subject to the water boil advisory, including the mainland and
Padre Island. As a result, City officials are seeking measures to hydraulically isolate the Flour
Bluff area, such that the residents in other parts of the City would not be affected by water
contamination that may be found in the water from that region.
Project Description:
The City of Corpus Christi, Texas, hereinafter called "City", and LNV, Inc. hereinafter called
"Engineer", agrees to the following Contract for Engineering Services associated with the Water
System Pressure Zone Boundary "Project". The purpose of this project is to provide hydraulic
modeling analysis of the water distribution system with the objective of evaluating the potential
options available for hydraulically isolating the Flour Bluff area into its own water system
pressure zone.
I. SCOPE OF SERVICES
A. BASIC SERVICES(N/A)
B. ADDITIONAL SERVICES
1. Prolect Management,Coordination.and Meetings
a. Project Management
1. The ENGINEER's Project Manager will continuously review the
status and the progress of the project to ensure a timely delivery
of services.
2. The Project Manager will prepare and submit invoices, and the
Project Manager will coordinate with the City to address any
technical or administrative concerns that may arise throughout the
execution of the project.
b. Project Meetings
For each meeting, the ENGINEER will prepare and distribute a meeting
agenda, presentation materials (if necessary), and written minutes to the
City. Decisions and specific action items will be clearly identified in the
notes.
1. Project Kickoff Meeting with the City
i. The ENGINEER will conduct a project kickoff meeting with
representatives of the City. The purpose of this meeting
will be to initiate the project and develop a working
understanding of the following:
1. Review project scope of work to identify project
alternatives
2. Identify information needed from the City
3. Develop a project meeting schedule
2. Coordination meetings with the City
i. The Project Manager will coordinate with the City to
address any technical or administrative concerns that may
arise throughout the execution of the project.
ii. The Project Manager will conduct up to two (2) meetings
with the City for coordination purposes.

3. Project meetings with the City and TCEQ
i. The ENGINEER will conduct one (1) meeting with the
Texas Commission on Environmental Quality (TCEQ) to
present the potential alternatives and determine whether
they meet the TCEQ's definition of a pressure zone
boundary.
ii. The ENGINEER will prepare and distribute a meeting
agenda, PowerPoint presentation identifying proposed
scope of work, and written minutes of this meeting to the
City. Decisions and specific action items will be clearly
identified in the notes.
2. Hydraulic Modeling
Utilizing the City of Corpus Christi Hydraulic Water Model, the ENGINEER will
evaluate up to six (6) extended period simulation modeling scenarios to
hydraulically isolate the Flour Bluff area. For each scenario, the ENGINEER will
modify the existing City of Corpus Christi Hydraulic Water Model. Modifications
will include,but not be limited to:
a. Demand scenarios to be analyzed including existing and future demands
b. Proposed infrastructure
1. Pipelines
2. Valves
3. Pumps(with assumed pump curves)
c. System connectivity
The scenarios will utilize the existing elevated tank configurations and the future
2021 elevated tank configurations identified in the City of Corpus Christi
Alternative Capacity Requirement (ACR) report. The scenarios to be evaluated
may include six(6)of,but not limited to,the following:
Existina Elevated Storaae Scenarios
a. Scenario 1 (Check valves on the three water mains entering into Flour
Bluff)—Perform an extended period hydraulic simulation and evaluate the
performance of the water distribution system under normal operating
conditions with check valves placed on each of the three(3)water mains
that convey drinking water to Flour Bluff.
b. Scenario 2 (Modifications to the Flour Bluff Elevated Storage Tank) —
Perform an extended period hydraulic simulation and evaluate the
performance of the water distribution system under normal operating
conditions with separate inlet/outlet piping installed on the Flour Bluff
Elevated Storage Tank along with modifications to the Flour Bluff
connections to the 24" transmission main feeding Padre Island.
c. Scenario 3 (Valve closure plan for the Staples St. Pump Station) —
Perform an extended period hydraulic simulation and evaluate the

performance of the water distribution system under normal operating
conditions with the valves and piping associated with the Staples St.
Pump Station reconfigured such that it delivers flows exclusively to Flour
Bluff.
d. Scenario 4 (Transmission Bypass to the Island) - Perform an extended
period hydraulic simulation and evaluate the performance of the water
distribution system under normal operating conditions with a new
transmission main placed from the mainland that would bypass Flour Bluff
and exclusively service the Island.
Future Elevated Storaae Scenarios
e. Scenario 5 (Check valves on the three water mains entering into Flour
Bluff)—Perform an extended period hydraulic simulation and evaluate the
performance of the water distribution system under normal operating
conditions with check valves placed on each of the three(3)water mains
that convey drinking water to Flour Bluff.
f. Scenario 6 (Valve closure plan for the Staples St. Pump Station) —
Perform an extended period hydraulic simulation and evaluate the
performance of the water distribution system under normal operating
conditions with the valves and piping associated with the Staples St.
Pump Station reconfigured such that it delivers flows exclusively to Flour
Bluff.
g. Scenario 7 (Transmission Bypass to the Island) - Perform an extended
period hydraulic simulation and evaluate the performance of the water
distribution system under normal operating conditions with a new
transmission main placed from the mainland that would bypass Flour Bluff
and exclusively service the Island.
For all scenarios evaluated, the ENGINEER shall create color-coded exhibits.
The exhibits shall include,but not be limited to,the following information:
a. Water age
b. System Pressures
c. Proposed infrastructure improvements
3. Enaineerina Letter Report
The ENGINEER shall prepare an engineering letter report for submission to the
City with the intent to provide the engineering letter report to TCEQ. The
engineering letter report will include, but not necessarily be limited to, the
following:
a. Modeling scenario descriptions
b. Modeling methodology including pump controls, assumptions,etc.
c. Modeling results in exhibit and tabular summary format

d. Cost estimates associated with the implementation of each analyzed
scenario
e. Estimated construction schedule for each analyzed scenario
f. Advantages and disadvantages associated with each analyzed scenario
II. DELIVERABLES
A. Draft and Final Engineering Letter Report
1. The ENGINEER shall provide one (1) hard copy and one (1) electronic copy of
the Draft Engineering Letter Report for review and comments from the City.
2. Upon receipt of comments, the ENGINEER shall prepare three (3) hard copies
and three(3)electronic copies of the Final Engineering Letter Report.
3. The Final Engineering Letter Report shall be sealed by a Registered Professional
Engineer licensed to practice in the State of Texas.
III. SCHEDULE
All work associated with the Corpus Christi Water System Pressure Zone Boundary
Analysis shall be completed within 10 weeks of Notice to Proceed.

IV. FEES
A. Fee for Basic Services. The City will pay the NE a fixed fee for providing for all
"Basic Services" authorized as per the table below. The fees for Basic Services
will not exceed those identified and will be full and total compensation for all
services outlined above, and for all expenses incurred in performing these
services. The fee for this project is subject to the availability of funds. The
Engineer may be directed to suspend work pending receipt and
appropriation of funds. For services provided, NE will submit monthly
statements for services rendered. The statement will be based upon A/E's
estimate (and with City's concurrence) of the proportion of the total services
actually completed at the time of billing. City will make prompt monthly payments
in response to NE's monthly statements.
B. Fee for Additional Services. For services authorized by the Director of Capital
Programs under Section I.B."Additional Services,"the City will pay the NE a not-
to-exceed fee as per the table below:

LNV shall perform said services and all acts attendant thereto with a reasonable standard of

Mandatory Requirements
INDEMNIFICATION
Consultant shall fully indemnify, hold harmless, and defend the City
of Corpus Christi and its officials, officers, agents, employees,
volunteers, directors and representatives ("Indemnitee") from and
against any and all claims, damages, liabilities or costs, including
reasonable attorney fees and defense costs, caused by or resulting
from an act of negligence, intentional tort, intellectual property
infringement, or failure to pay a subcontractor or supplier committed
by Consultant or its agent, consultant under contract or another entity
over which Consultant exercises control while in the exercise of
rights or performance of the duties under this agreement. This
Indemnification does not apply to any liability resulting from the
negligent acts or omissions of the City of Corpus Christi or its
employees, to the extent of such negligence.
Consultant must, at City's option, defend Indemnitee and with
counsel satisfactory to the City Attorney.
Consultant must advise City in writing within 24 hours of any claim or
demand against City or Consultant known to Consultant related to or
arising out of Consultant's activities under this Agreement.

DEFINITIONS
