CONTRACT FOR PROFESSIONAL SERVICES
AMENDMENT NO. 5
The City of Corpus Christi, Texas hereinafter called "CITY", and Urban Engineering hereinafter called
"ENGINEER," agree to the following amendment to the Contract for Professional Services for Padre
Island Water Supply (Project No. E10172), as authorized and amended by:
Original Agreement November 5, 2010 Administrative Approval $49,870.00
Amendment No. 1 June 21, 2011 Motion No. M2011-134 $364,370.00
Amendment No. 2 February 26, 2013 Motion No. M2013-037 $182,976.00
Amendment No. 3 July 8, 2014 Motion No. M2014-085 $141,323.00
Amendment No. 4 April 7, 2015 Administrative Approval $46,500.00
Exhibit "A", Section I. Scope of Services shall be amended to include additional engineering services
as specified in the attached Amendment No. 5 Exhibit "A".
Exhibit "A", Section III. Fees shall be amended as specified in the attached Amendment No. 5 Exhibit
"A ", for a revised fee not to exceed $4,250.00 (Four Thousand Two Hundred Fifty Dollars and Zero
Cents), for a total restated fee not to exceed $789,289.00 (Seven Hundred Eighty-Nine Thousand
Two Hundred Eighty-Nine Dollars and Zero Cents). Monthly invoices shall be submitted in
accordance with Exhibit "B".
All other terms and conditions of the November 5, 2010 contract between the City and Engineer, and any
amendments to that contract, which are not specifically addressed herein shall remain in full force and
effect.

Subject: Amendment No.5— Padre Island Water Supply E10172— 18 Inch Water Transmission
Main and 4 Inch MIS Conduit
Dear Jerry,
This proposal is in response to a request from City staff to provide professional services for an
extension of the 18-inch water transmission main and 4-inch MIS conduit, from the termination
point of the Padre Island Water Supply project to Aquarius Street. We propose the following
contract amendment to the Padre Island Water Supply (#E1D172) to cover the bidding,
construction administration and additional services not covered under Amendment No. 4;
I. SCOPE OF SERVICES:
BASIC SERVICES
Bid Phase Services
The A/E will provide the following bid phase services:
a. Attend a Pre-Bid Meeting
b. Review and prepare responses to requests for information (RFI's) during the bid phase
c. Prepare addenda as needed for the project execution
d. Attend the Bid Opening
e. Prepare a bid evaluation and provide a written recommendation to the City
Construction Phase Services
The A/E will perform contract administration to include the following:
a. Participate in a pre-construction meeting conference and provide a recommended
agenda for critical construction activities and elements that impact the project.
b. Review shop and working drawings, materials and other submittals for conformance to
contract documents.
c. Review field and laboratory tests.

d. Provide interpretations and clarifications of the contract documents for the contractor
and authorize required changes, which do not affect the contractor's price and are not
contrary to the general interest of the City under the contract.
e. Make regular visits to the site of the Project to confer with the City project inspector and
contractor to observe the general progress and quality of work, and to determine, in
general, if the work is being done in accordance with the contract documents. This will
not be confused with the project representative observation or continuous monitoring of
the progress of construction.
f. Prepare change orders as authorized by the City (coordinate with the City's construction
division).
g. Make final inspection with City staff and provide the City with a Certificate of
Completion for the project.
ADDITIONAL SERVICES
U.S. Army Corps of Engineers Nation Wide Permit
NE supplemented the wetland delineation carried out in Amendment No. 3, to include the
proposed 18-inch water transmission main and 4-inch MIS conduit, coordinated with the
USACE, prepared a Nation Wide Permit application and assisted in pursuit of USACE
authorization for the impacts associated with the 18-inch water line and 4-inch MIS Conduit
extension. The following tasks were performed;
a. Wetland Delineation:
NE further assessed the wetland delineation completed for the gas line extension within
the proposed work corridor in accordance with the 1987 U.S. Army Corps of Engineers
(USACE)Wetland Delineation Manual and Regional Supplement.
NE included the proposed 18-inch water transmission main and 4-inch MIS conduit in the
draft wetland delineation report to City for review and comment. After receiving approval
from City, NE submitted the delineation report to USACE with a request for a preliminary
jurisdictional determination or verified determination.
NE coordinated with USACE to attain a preliminary jurisdictional determination. This task
included site visits with USACE and responding to minor questions and requests for
additional information.
b. Pre-construction Notification (PCN):
NE prepared a Pre-construction Notification (PCN) for applicable USACE Nationwide
Permits and/or Regional General Permit for the gas pipeline, water pipeline and MIS conduit
installation and submitted the PCN to USACE with a request for concurrence.
NE coordinated with USACE in attempt to obtain concurrence from USACE that the project
is eligible for authorization under Nationwide Permit and/or Regional General Permits
Once the construction is complete the A/E will carry out a post construction survey as required
by the USACE permit.
a. Post Construction Survey:
NE will conduct a post-construction survey and prepare a letter report for the OWNER's
review and comment. After receiving approval from the owner, NE will submit the post-
construction survey letter report to the USACE. NE will coordinate with the USACE in an
attempt to attain approval of the survey.

The post-construction letter report will include; 1) description of the physical habitat in the
project area, both prior to and after construction, 2) a description of re-vegetated types and
trends, 3) vegetation/open water coverage, 4) water depths, 5) noted fish and wildlife use,
and 6) photographic documentation of the project area.
This task will include one site visit to the project area to document the vegetative growth
along the construction ROW.
Texas DOT Permit
NE coordinated with TxDOT and prepared a permit application to include the 18-inch water line
and 4-inch MIS conduit extension within their right-of-way.
Texas General Land Office Authorization
NE coordinated with the TGLO and prepared an authorization to construct the 18-inch water
line and 4-inch MIS conduit extension within their jurisdictional area (TxDOT ROW).
Warranty Phase
NE will provide a warranty inspection of the project site toward the end of the 12-month
warranty period and generate a warranty items punch list.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi,Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self-employed
person, partnership, corporation,joint stock company,joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non-profit organizations.
