AMENDMENT NO. 1
CONTRACT FOR PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "City", and FREESE AND NICHOLS, INC.
hereinafter called "Engineer", agree to the following amendments to the Contract for Engineering
Services for Avers Street Ocean Drive to Alameda Street (Protect No. E13092) BOND 2014, as
authorized and administratively amended by:
Original Contract March 18, 2014 Ordinance No. 030127 $811,935.00
In the Original Contract, Exhibit "A", Section I. Scope of Services, Part A. Basic Services shall be
amended to include additional Item No. 2 Design Phase as set forth in the attached AMD No. 1, Exhibit
In the Original Contract, Exhibit "A", Section I. Scope of Services, Part B. Additional Services shall be
amended to include additional Item No. 9 Public Involvement and Item No. 11 Televising of Utility
Lines as set forth in the attached AMD No. 1, Exhibit "A".
In the Original Contract, Exhibit "A", Section III. Fees, Summary of Fees shall be modified and is
attached as AMD No. 1 Exhibit "A" for a fee not to exceed $49,744.00 (Forty Nine Thousand Seven
Hundred Forty Four Dollars and Zero Cents), for a total restated fee not to exceed $861,679.00 (Eight
Hundred Sixty One Thousand Six Hundred Seventy Nine Dollars and Zero Cents). Monthly invoice
will be submitted in accordance with Exhibit "B".
All other terms and conditions of the March 18, 2014 contract between the City and Engineer, and of any
amendments to that contract, which are not specifically addressed herein shall remain in full force and
effect.

Amendment No. 1
Dear Mr. Edmonds,
Freese and Nichols, Inc. (FM)would respectfully request your consideration of our amendment#1 for
Ayers Street—Ocean Drive to Alameda Street(City Project No. E13092). The amendment includes
additional design phase services to prepare plans,specifications, and details to add a concrete
pavement alternative in addition to the current asphalt design. Also included is additional design
services and public outreach necessary for the closure of Booty Street at the Ayers/Santa Fe intersection
to provide additional parking spaces. FNI respectfully requests a contract amendment in the amount of
$49,744 to address the additional time and effort required to support these additional project efforts.

AMENDMENT NO. 1
1. SCOPE OF SERVICES
A. Basic Services.
Basic Services will include the following in addition to those items shown below:
Design Phase
1. Provide additional design services to add a reinforced concrete pavement design
alternative for Ayers Street. The concrete pavement design will be in addition to the
current HMAC asphalt design. Prepare project detail sheets for concrete pavement
including typical details, cross sections and jointing layout sheets. Prepare
specifications, estimates and additional bid form documents for concrete pavement.
2. Provide additional design services for the conversion of Booty Street to a one-way
roadway from the intersection of Ayers to 5th Street. Provide additional survey and
striping and signage on Booty Street to add parking spaces and mitigate for the
existing parking spaces on Ayers Street adjacent to Sandi's Diner.
B. Additional Services
Additional Services will include the following in addition to those items shown below:
Public Outreach
1. Provide additional public outreach to support the conversion of Booty Street from a
two-way section to a one-way section. Conduct three(3) additional meetings with
property owners along Booty Street between Ayers and 5th Streets.
2. Provide additional public outreach to coordinate with Christus Spohn Hospital and
their plans to expand their Shoreline campus. Conduct three (3) additional meetings
with Christus Spohn Hospital to review their plans and coordinate design and
construction activities and schedule.
Televising of Utility Lines
3. Provide cleaning and televising of existing sanitary sewer system lines within the
project limits to verify their existing condition and recommend repairs and/or
replacement as needed. This TV investigation includes approximately 1220 linear
feet of existing 10" sanitary sewer and 50 linear feet of existing 6"sanitary sewer.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the City
Council of the City of Corpus Christi,Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to have an
effect on that interest that is distinguishable from its effect on members of the public in general or a
substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part-
time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or commercial, and
whether established to produce or deal with a product or service, including but not limited to, entities
operated in the form of sole proprietorship, as self-employed person, partnership, corporation,joint
stock company, joint venture, receivership or trust, and entities which for purposes of taxation are
treated as non-profit organizations.
