§ KNOW ALL BY THESE PRESENTS:
COUNTY OF NUECES §
This agreement is entered into between the City of Corpus Christi, a Texas home-rule municipal
corporation ("City"), acting through its duly authorized City Manager, or his designee ("City
Manager"), and The Behavioral Health Center of Nueces County, formerly The Nueces County Mental
Health and Mental Retardation Community Center Foundation, a Texas nonprofit corporation
("Lessee").
A. The City and Lessee executed a lease agreement (the "Lease") on May 20, 2008, which
became effective on July 20, 2008. By the terms of the Lease, the Premises commonly known
as 1502 S. Brownlee Boulevard, Corpus Christi, Nueces County, Texas, also known by its legal
description as the northwest 100 feet of Block 1002, Bay Terrace 2, conveyed to the City by
W.R. Hubler, Sr., in Volume 2241, Page 122, of the Deed Records of Nueces County, Texas
("Premises"), were leased to Lessee for a term of ten (10) years beginning on July 20, 2008,
and ending July 20, 2018.
B. Lessee wishes to surrender the Lease and all rights to possession of the leased Premises, and to
release the City from its obligations under the Lease.
C. The City wishes to accept the surrender and to release the Lessee from its obligations under
the Lease.
THE PARTIES THEREFORE AGREE AS FOLLOWS:
In consideration of the mutual promises contained in this Agreement, Lessee will surrender the Lease
and vacate the Premises described in this Agreement on or before January 1, 2016. The City will
accept the surrender and the Premises. The City and Lessee will discharge and release each other
from all obligations under the Lease as of that date.
EXECUTED IN DUPLICATE, each of which shall be considered an original, on the 9 day of
