Williams Drive Improvements Phase 3— Staples Street to Airline Road City Project No: E11116 Revised Contract Amendment No. 3 — Add'I Construction Administration Funds LJA Project No. C007-12010 Dear Mr. Hale: I. TIME & MATERIALS CONSTRUCTION ADMINISTRATION BUDGET As requested, we have prepared this contract amendment to remove Basic Services: CONSTRUCTION PHASE and create Additional Services: CONSTRUCTION PHASE ASSISTANCE, a Time and Materials contract line item to provide the City with assistance, as requested, during construction. With the creation of Additional Service: CONSTRUCTION PHASE ASSISTANCE, all requirements of Basic Services: CONSTRUCTION PHASE are removed from the Contract, including provision of a Certificate of Completion and preparation of Record Drawings. With this contract amendment, LJA also proposes to create an Additional Service for the preparation of Record Drawings at the completion of construction. Under Additional Services: CONSTRUCTION PHASE ASSISTANCE, LJA will provide assistance to the City during construction, as requested. Requests for services shall be submitted to LJA via email from City staff (Construction Inspection or Engineering Services), including Calendar Meeting Requests. Verbal requests for services must be followed by an email to LJA prior to action being taken by LJA. Receipt of email requests, or Calendar Meeting requests, from City Staff shall be considered by LJA as Authorization to Proceed on the requested services. Services provided under this line item shall be invoiced to the City monthly based upon the attached Table 1 —Rate Schedule and shall include time spent during the invoicing period. If it is apparent that additional efforts will be required beyond the estimated Contract budget after 75% of the estimated budget for this Line Item has been spent, LJA will prepare a Contract Amendment for additional fees based upon an estimate of the amount of effort remaining to complete the Project. Work will not proceed beyond the approved budget. The following services are excluded from this Contract: a) Preparation of change orders; b) Review of shop drawings. (This does not exclude review of material submittals, if requested.); c) Review/approval of Contractor pay requests; and d) Preparation of a Certificate of Completion at the end of the Project. AMD. No.3 (City Project No: E11116) Under Additional Services: PREPARATION OF RECORD DRAWINGS, LJA will provide the following services: Review Contractor-provided construction red-line" drawings. Prepare Project record drawings and provide a reproducible set and electronic file (AutoCAD r.14 or later) within two (2) months of final acceptance of the project. All drawings shall be CADD drawn using dwg format in AutoCAD, and graphics data will be in dxf format with each layer being provided in a separate file. Attribute data will be provided in ASCII format in tabular form. All electronic data will be compatible with the City GIS system. II. BASIS OF COMPENSATION LJA proposes to perform CONSTRUCTION PHASE ASSISTANCE services on a Time and Materials basis with an estimated budget of$105,000. LJA proposes to perform PREPARATION OF RECORD DRAWINGS services for a Fixed Fee of $11,000. To create the funds for these two (2) new Additional Services, LJA proposes to reallocate funds from Basic Services: CONSTRUCTION PHASE and Additional Services: CONSTRUCTION OBSERVATION SERVICES as shown in the attached Amendment No. 3, Exhibit "A" Summary of Fees, thereby making this a zero dollar contract amendment. III. SCHEDULE OF PAYMENT Invoices shall be prepared, submitted and paid on a monthly basis in accordance with the original contract. Invoices will be based upon engineering efforts spent at the time of invoicing. IV. OWNERSHIP OF DOCUMENTS Original documents and construction plans belong to, and remain the property of the Client, provided that the Engineer has received full compensation due, in consideration of which it is mutually agreed that the Client will use them solely in connection with the Project, except with the express consent of the Engineer. The Engineer may retain reproducible copies of such documents. Originals of the recorded plat and field books remain the property of the Engineer and the Client may request copies be made at his expense. Contract Amendment No. 3 documents are attached.
