Kosarek Clark and Jeffrey Dane Clark ("Grantor"), whose address is P.O. Box 1406
George West, Texas 78022, for and in consideration of the sum of One and No/100
Dollar ($1.00) paid by the City of Corpus Christi, a Texas home-rule municipal
corporation ("Grantee"), whose address is 1201 Leopard Street, Corpus Christi, Texas,
78401, the receipt of which is acknowledged, has granted, sold and conveyed and by
these presents does grant, sell and convey to the Grantee, its successors, legal
representatives, permitted assigns and franchisees, the free and uninterrupted use,
liberty, privilege, and easement, of going in, on, over, under, and along a certain tract of
land situated in Nueces County, Texas and being described as follows:
Field note description of a Right-of-way over and across a portion of Lot 2,
Section 7, Bohemian Colony Lands, as shown on the map recorded in
Volume A, Page 48, Map Records of Nueces County, Texas, which
descriptions are attached to and incorporated in this document as "Exhibit
A", and depicted on the field notes location maps attached to and
incorporated in this document as "Exhibit B", the exhibits collectively being
referred to and known as the "Premises."
Together with the free ingress, egress, and regress to and for the Grantee, all for the
purpose of erecting, constructing, installing, laying, replacing, servicing, repairing, using,
maintaining, inspecting, reconstructing, modifying, removing, operating and keeping
utility lines in, on, over, under, and along the Premises, including but not limited to
water, wastewater, storm water, storm water detention, filtration, drainage, and gas, and
together with all lines, pipes, conduits, and other equipment, improvements, and
appurtenances used in the supply and provision of public utilities.
TO HAVE AND TO HOLD, all and singular, the rights and privileges as described above
to the Grantee, its successors, legal representatives, permitted assigns, and
franchisees, for the proper and public use as a right-of-way and for so long as used for
such purposes and, if the use of said right-of-way be ever abandoned, then, in that
event, the aforesaid rights and privileges shall cease.

of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas, out of a 38.94 Acre Tract as
described in the Last Will of Arno W. Behmann,Cause No. 29215-4, of the Probate Records,County Court at Law
No. 4,Nueces County,Texas, and a General Warranty Deed conveying half interest from Karen Kay Kosarek Clark
to Jeffrey Dane Clark, as recorded in Document Number 2015042838, of the Official Public Records of Nueces
County,Texas; said 0.486 Acre Tract being more fully described by metes and bounds as follows:
Beginning, at a 5/8 Inch Iron Rod with yellow cap stamped "Bass and Welsh" Found, on the common
boundary line of Lot 7 of the said Section 7 and the said Lot 2, the Northwest boundary line of the said 38.94 Acre
Tract, being the West corner of a 89' x 25' Rectangular Tract of Land, as described in Document Number
2012031484, of the said Official Public Records of Nueces County, Texas, the Southeast corner of Dorado Street
Right-of-Way, a 39 foot public roadway, as shown on Los Encinos 10 Acre School Tract, a map which is recorded
in Volume 26, Page 63, said Map Records, for the East corner of a 10 Acre Tract described in a Special Warranty
Deed, from Seaside Builders, LLC, to Corpus Christi Independent School District, as recorded in Document
Number 2015033559, said Official Public Records, said 10 Acre Tract being out of a 45.316 Acre Tract described
in a Warranty Deed with Vendor's Lien from AHA Housing Alternatives, LLC to Seaside Builders, LLC, as
recorded in Document Number 2014045952,Official Public Records of Nueces County, Texas and this Tract;
Thence, South 61°49'40" East, with the Southwest boundary line of the said Save and Except Tract, the
Northeast boundary line of the said 38.94 Acre Tract, 25.00 Feet, to a 5/8 Inch Iron Rod with red plastic cap
stamped"URBAN ENGR. C.C. TX" Set, for the Northeast corner of this Tract;
