The compensation agreed upon in this Change Order is full,complete and final payment for all costs the Contractor may incur as a result of or relating
to this change whether said costs ore known,unknown,foreseen or unforseen at this time,including without limitation,any cost for delay,extended
overhead,ripple or impact cost,or any other effect on changed or unchanged work as a result of this Change Order.

PROJECT: Mary Rhodes Phase 2 Pipeline Project—Pipeline Contract
Mr. Edmonds,
This memo serves as a summary for the reasons and recommendation for the items in Change order No.
5 for the pipeline contract.
Item No 1.—CP 20/RCP 03 Pipeline grade adjustment at RR berm at station 1037+60
This Request for Proposal to the contractor was generated from an Owners request to change the profile of the
pipeline in this location.The change made the pipeline grade line flatter and took out a hill that would be
challenging to work around if maintenance procedures needed to be done in this location.Two additional days of
Contract time are recommended for this work.
Item No 2.—CP 04 Conflict-Enterprise Pipeline affecting Tunneling Sub at station 1132+65
This claim from the contractor was to compensate for the delays and additional work associated with an
Enterprise gas line that was 2.5 foot deeper than indicated in the Contract Documents.This required the
contractor to excavate deeper, lower the location of the pipeline casing and use additional materials to
compensate for the extremely wet soils in this area.The onsite CM team monitored the situation closely and
documented the work described in this change package. Four additional days of Contract time are recommended
for this work.
Item No 3.—CP 07 FOC Conflict @3131/CR423
This claim from the contractor was to compensate for the delays associated with the discovery of buried fiber
optic cable and telephone lines that were not indicated in the Contract Documents.The contractor was able to
reinstall the pipeline at a slightly different grade and avoid production of any further piping or relocation of the
existing utilities. One additional day of Contract time is recommended for this work.
Item No 4.—CP 08 Field location verification of new FOC utilizing Vac Truck at station 1735+25
This claim from the contractor was to compensate for the delays associated with locating a fiber optic cable that
was installed after this contract was let. The contractor utilized a vacuum truck to locate this new utility.The work
took close to a week to perform however equipment and manpower were able to be utilized in other areas of the
project minimizing the impact of the delay claim.The onsite CM team monitored the situation closely and
documented the work described in this change package. Four additional days of Contract time are recommended
for this work.

Item No 5.—CP 10/RCP 08 Move power from MOV3001 to MOV3003(Existing Emergency Breaker)
This Request for Proposal to the contractor was generated from LNRA's request to change the power supply
connection location for two new motor operated valves so they would be connected to an existing backup
emergency generator. No additional days of Contract time are recommended for this work.
Item No 6.—CP 11 Bollard modifications at rectifiers
This claim from the contractor was to compensate for the additional work associated with revising fabrication of
the protective bollard system protecting the cathodic protection system rectifier cabinets.The specified cabinet
doors would not be able to open fully for maintenance with the standard bollard system hence the modifications.
No additional days of Contract time are recommended for this work.
Item No 7.—CP 18 Photocells for GST lighting
This claim from the contractor was to compensate for the additional work associated with adding photocells at the
existing pole mounted LED lights at the new ground storage tank.This change will allow the pole mounted lights to
operate in sync with the photocells on the electrical control structure. No additional days of Contract time are
recommended for this work.
Item No 8.—CP 19 Additional AEP easement surveys for underground electrical
This claim from the contractor was to compensate for the additional work associated with obtaining surveys for
new easements that AEP required to run underground electrical supply for 9 of the 18 cathodic protection system
rectifiers. No additional days of Contract time are recommended for this work.
Item No 9.—CP 21 Unsuitable soils at eastside of Navidad River bottom
This claim from the contractor was to compensate for the additional work associated with installation of pipe
above unsuitable soils. In the river bottom on the east side of the Navidad River the contractor encountered highly
plastic,wet and unstable soils in the bedding area of the pipeline profile.The unstable soils needed a bedding layer
that would stabilize the subgrade for sound pipe installation. Bull rock and 1.5"gravel were brought in and utilized
to establish a solid bed for the pipe sections.The contractor had to outsource these materials which accounts for a
significant part of the cost in this change.The onsite CM team monitored the situation closely and documented
the work described in this change package.Four additional days of Contract time are recommended for this work.
Item No 10.—Additional days added to Contract-15 Calendar Days
Embedded within the nine items listed above, FNI recommends the addition of 15 additional days to the overall
Contract time.
Based on negotiations between the PCM and the Contractor FNI recommends approving these changes.The
pricing is considered fair and reasonable as well as the requested contract time for each item.
