THAT,SOUTH PADRE INVESTMENT,L.P.,a Texas limited partnership.,whose address is 700
North. St. Mary's Street, Suite 1825, San Antonio, Bexar County, Texas, ("GRANTOR") in
consideration of TEN DOLLARS(S10.00),paid by the CITY OF CORPUS CHRISTI,TEXAS,
herein called (`GRANTEE"), of P.O. Box 9277, Corpus Christi, Nueces County, Texas 78469-
9277.the receipt of which is hereby acknowledged,has granted,sold and conveyed.and does hereby
grant,sell and convey to Grantee,a Texas Home Rule municipal corporation,its successors and legal
representatives,the free and uninterrupted use,liberty,privilege,and easement of going in,on,over,
under and along a certain tract of land situated in Nucces County, "Texas and being described as
fol lows:
See the metes and bounds property description attached and incorporated as
`.Exhibit A". Maps showing the location of the UTILITY EASEMENTS •
TOGETHER WITH TEMPORARY CONSTRUCTION EASEMENTS are
attached and incorporated as"Exhibit B". ("Premises")
The Temporary Construction Easement is further described as a 15'wide strip
and adjacent to the.permanent Utility Easement. Said Temporary Construction
Easement is to he used for working space during construction.This Temporary
Construction Easement automatically terminates upon one year from the start
of construction on the premises.
SPECIAL PROVISIONS:
The City of Corpus Christi agrees to restore the land within the easement area
to the same or better condition as existed prior to construction. All construction
is to be done in a prudent and workmanlike manner.
Together with the free ingress,egress and regress to and for Grantee,and its franchisees to construct,
service,repair,maintain,inspect,lay,operate and keep public utility lines under,on and along said
Premises.

Grantor reserves all of the oil,gas and other minerals in and under the Property but waives all rights
of ingress and egress to the surface thereof for the purpose of exploring, developing, mining or
drilling for same.
Validly existing easements, rights-of-way, and prescriptive rights, whether of record or not; all
presently recorded and validly existing restrictions,reservations,covenants,conditions,oil and gas
leases, mineral interests, and water interests outstanding in persons other than Grantor, and other
instruments,other than conveyances of the surface fee estate,that affect the Property;validly existing
rights of adjoining owners in any walls and fences situate on a common boundary;and discrepancies,
conflicts, or shortages in area or boundary lines; and any encroachments or overlapping of
improvements.
TO HAVE AND TO HOLD,ALL AND SINGULAR,the rights and privileges aforesaid to Grantee,
its successors, legal representatives, and franchisees for the use as a UTILITY EASEMENT and
right-of-way for so long as used for such purpose,and if the use of said easement and right of way is
ever abandoned,then the aforesaid rights and privileges cease.

The person signing this easement as Grantor,or signing on behalf of the Grantor, represents,warrants, and
guarantees that they are the Grantor or have the authority to act on behalf of the Grantor for the purpose
and consideration stated.
