THAT MIGGO LIMITED PARTNERSHIP ("Grantor"), of 5305 River Oaks Drive, Corpus
Christi,Texas 78413 for and in consideration of$10.00(TEN DOLLARS),to me in hand paid by
the CITY OF CORPUS CHRISTI, ("Grantee"),the receipt of which is hereby acknowledged,
has granted, sold, and conveyed, and by these presents does grant, sell, and convey unto the said
City of Corpus Christi, of 1201 Leopard Street, Corpus Christi,Nueces County, Texas 78401, a
Texas Home Rule municipal corporation, its successors legal representatives, and permitted
assigns,the free and uninterrupted use,liberty,privilege,and easement of going in,on,over,under
and along a certain tract of land situated in Nueces County,Texas and being described as follows:
See the metes and bounds property description attached and incorporated as
"Exhibit A"(Utility Easement)and"Exhibit A-1"(Temporary Construction
Easement). (Premises)
A map showing the location of the Utility Easement TOGETHER WITH A
TEMPORARY CONSTRUCTION EASEMENT is attached and
incorporated as"Exhibit B".
Said Temporary Construction Easement is to be used for working room and
storage of materials and machinery during the construction phase of the
waterline. The Temporary Construction Easement automatically terminates
upon 1) completion and acceptance of the project by the City Manager of
the City of Corpus Christi, Texas or its designee or 2) one year from the
recording date of this easement,whichever occurs first.
Together with the free ingress,egress and regress to and for the City of Corpus Christi,Texas,its
officers,employees, agents,representatives,contractors and franchisees,FOR THE PURPOSES
OF erecting, constructing, installing, laying, replacing, servicing, repairing, using, maintaining,
inspecting,reconstructing,modifying,removing,operating,and keeping any and all public utilities
(including but not limited to water, wastewater, storm water, storm water detention, filtration,
drainage,and gas,together with all lines,pipes,conduits,and other equipment,improvements and
appurtenances used in the supply ad provision of public utilities.)

TO HAVE AND TO HOLD,ALL AND SINGULAR,the rights and privileges aforesaid to the City
of Corpus Christi, Texas, its successors, legal representatives,permitted assigps, and franchisees
for the use as a UTILITY EASEMENT and right-of-way for so long as used for such purpose,and
if the use of said easement and right of way is ever abandoned, then the aforesaid rights and
privileges cease.
Executed in duplicate, each of which constitutes an original.

easement being more fully described by metes and bounds as follows:
Beginning at a drill hole with crow foot found on a concrete curb at the intersection of the north boundary of Kinney Street
with the east boundary of Carrizo Street for the Point of Beginning of this description,for the southwest corner of said Lot I I
and for the southwest corner of this utility easement;
Thence,with said east boundary of Carrizo Street,same being the west boundary of said Lot 11 and of this utility easement.

Temporary Construction Easement(TCE)being more fully described by metes and bounds as follows:
Commencing at a drill hole found on the lower edge of a concrete retaining wall located on the north boundary of Kinney
Street for the southeast corner of said Lot 11;
Thence,with said northerly boundary of Kinney Street,same being the east boundary of said Lot II,North 20°30'27"West,a
distance of 15.04 feet for Point of Beginning of this description and for the southeast corner(no monumentation found or set)
of this TCE;
Thence,with the south boundary of this TCE,South 65°08'30"West,a distance of 138.46 feet for the southwest corner(no
