("Consultant"), agree to the following amendments to the Contract for Professional Services for Horne Road Improvements Avers Street to Port Avenue BOND 2012(Project No. E12100): Original Contract January 29, 2013 Motion No. M2013-021 $244,362.50 Amendment No. 1 August 16, 2013 Administrative Approved $17,000.00 Amendment No. 2 August 26, 2014 Ordinance No. 030264 $104,000.00 Amendment No. 3 August 23, 2016 Administrative Approved $21,030.00 In the Original Contract, Exhibit"A", Section I. Scope of Services shall be amended as set forth in the attached Amendment No. 4, Exhibit"A". In the Original Contract, Section III. shall be amended based on the modified scope of services in the attached Amendment No. 4, Exhibit "A" for a fee not to exceed $47,074.00, for a total restated fee not to exceed $433,466.50. All other terms and conditions of the January 29, 2013 Contract for Professional Services between the City and Consultant,and of any amendments to that contract,which are not specifically addressed herein shall remain in full force and effect. Box 9277 Corpus Christi, TX 78469-9277 Re: Request for Contract Amendment No. 4 Horne Road Improvements-Ayers Street to Port Avenue (City Project E12100) Bond 2012 Program Dear Mr. Edmonds: Naismith Engineering, Inc. (NEI) respectfully submits this request for an amendment to our contract for engineering and related services on the above referenced project. As you are aware, there have been several things that have occurred on the project where the City has requested that we provide services outside the scope of our original contract and previously approved amendments. Some of these additional services resulted from the City's decision to terminate the original construction contract with Salinas Construction Technologies, Ltd. (Salinas) and letting a new construction contract with Clark Pipeline Services, J.V. (Clark), while others resulted from changes requested by City personnel. We believe we have faithfully assisted the City with these additional requested services and that these additional services have allowed the City to keep this project progressing toward completion. This letter outlines the nature and extent of the additional services we have provided and presents our request for a contract amendment, broken out by several categories of additional work. Construction Contract Termination Assistance NEI performed additional services in conjunction with the City's termination of the original construction contract with Salinas in association with termination of the Salinas Contract. Including meetings with City and Contractor, correspondence with Contractor, developing documentation (RFI's, EPP, Correspondence, emails, misc. data, etc.), coordinating with City Legal Department and coordination with the Bonding Company. This time and costs were incurred during the period that the Salinas contract was extended through final termination on June 19, 2015. The additional cost associated with the construction contract termination was $18,862.50. 4501 Gollihar Road. Director of Capital Programs City of Corpus Christi March 11, 2016 Page 2 Remaining Assistance with Bonding Company and Closeout It is anticipated that the City will require additional assistance during the closeout of the contract and coordination with the Bonding Company. The estimated cost for the closeout is $5,000. Contractor Debarment Proceedings As you are aware, the City opted to proceed with Debarment proceedings to exclude Salinas Construction from completing any City of Corpus Christi projects based on past performance on numerous contracts, including the Horne Road Project. NEI was asked to provide documentation and correspondence related to issues on the Horne Road Project. NEI performed additional services in conjunction with the City's debarment proceedings for Salinas Construction. Including meetings with City Staff, developing documentation (RFI's, EPP, Correspondence, emails, misc. data, etc.), coordinating with City Legal Department and discussions with representative from the Meridian Group Mr. Karl Moser. These costs incurred during the process was$2,500. Transition to new Contractor NEI assisted the City with assessing the work completed by the Salinas Contract and developing a plan for hiring Clark Pipeline Services to complete the project. Services included as-built surveys, pavement condition assessments, revising designs, developing cost estimates and coordinating the effort to hire the new contractor. This costs were incurred during the process was $20,711.50 Fee Summary 1. Contract Termination Assistance $18,862.50 2. Remaining Future Assistance $ 5,000.00 3. Debarment Proceedings $ 2,500.00 4. Transition to New Contractor $20,711.50 Total $47,074.00 NEI believes that we have aggressively worked with the City to keep this project moving and have not used the fact that these services were outside the scope of our amended contract as an excuse to delay the project. However, we also believe that we are due compensation for these additional services.
