Alty Enterprises, Inc. ("Grantor"), whose address is 1533 Flour Bluff Drive, Suite 101,
Corpus Christi, Texas 78418, for and in consideration of the sum of One and No/100
Dollar ($1.00) paid by the City of Corpus Christi, a Texas home-rule municipal
corporation ("Grantee"), whose address is 1201 Leopard Street, Corpus Christi, Texas,
78401, the receipt of which is acknowledged, has granted, sold, and conveyed and by
these presents does grant, sell, and convey to the Grantee, its successors, legal
representatives, permitted assigns and franchisees, the free and uninterrupted use,
liberty, privilege, and easement of going in, on, over, under, and along a certain tract of
land situated in Nueces County, Texas, and being described as follows:
Field note descriptions for a utility easement, over and across portions of
Lot 7, Section 20, Flour Bluff and Encinal Farm and Garden Tracts, as
shown on the map recorded in Volume A, Pages 41-43, Map Records of
Nueces County, Texas, which description is attached to and incorporated
in this document as "Exhibit A" and depicted on the field notes location
map attached to and incorporated in this document as "Exhibit B", the
exhibits collectively being referred to and known as the "Premises."
Together with the free ingress, egress, and regress to and for the Grantee, all for the
purpose of erecting, constructing, installing, laying, replacing, servicing, repairing, using,
maintaining, inspecting, reconstructing, modifying, removing, operating and keeping
utility lines in, on, over, under, and along the Premises, including but not limited to
water, wastewater, storm water, storm water detention, filtration, drainage, and gas, and
together with all lines, pipes, conduits, and other equipment, improvements, and
appurtenances used in the supply and provision of public utilities.
TO HAVE AND TO HOLD, all and singular, the rights and privileges as described above
to the Grantee, its successors, legal representatives, permitted assigns, and
franchisees, for the proper and public use as a utility easement and for so long as used
for such purposes and, if the use of said utility easement be ever abandoned, then, in
that event, the aforesaid rights and privileges shall cease.

Fieldnotes, for a 0.258 Acre Utility Easement, of Lot 7, Section 20, Flour Bluff and Encinal Farm and
Garden Tracts, a map of which is recorded in Volume A, Pages 41-43, Map Records of Nueces County,
Texas; said 0.258 Acres being a portion of a called 16.811 Acre Tract described in Special Warranty
Deed with Vendor's Lien from AMG 1031 LLC, a Texas limited liability company to Alty Enterprises,
Inc., recorded in Document No. 2006031089, Official Public Records of Nueces County, Texas; said
0.258 Acre Utility Easement and Drainage Maintenance Strip, being more fully described by metes and
bounds as follows:
Commencing, at a 5/8 Inch Iron Rod Found, on the Southwest Right-of-Way line of Saratoga
Boulevard, a 120 foot wide public roadway, being the East corner of Lot 1, Block 1, The Vineyards
Unit Four, a map of which is recorded in Volume 68, Page 318-319, of the said Map Records, for the
North corner of a 2.266 Acre Tract described in a Special Warranty Deed from AMG 1031 LLC, a
Texas limited liability company to L C Alty, LTD, recorded in Document No. 2006062879, of the said
Official Public Records;
Thence, South 28°41'56" West, with the common boundary line of the said Lot 1, the said
2.266 Acre Tract, and the said 16.811 Acre Tract, at 280.68 Feet, pass a 5/8 Inch Iron Rod Found, for
the West corner of the said 2.266 Acre Tract, a corner of the said 16.811 Acre Tract, in all 428.74 Feet,
to a point on the said common boundary line;
Thence, South 61°18'04" East, 45.00 Feet, over and across the said 16.811 Acre Tract, to the
Point of Beginning, the Southeast boundary line of a 45 Foot Wide Drainage Easement described in
Volume 1787, Page 478, Deed Records of Nueces County, Texas, for the North corner of this
Easement;
Thence with the boundary of this Easement as follows:
