SCOPE OF SERVICES, PART A. BASIC SERVICES shall be modified as shown below. 3. Construction Administration Phase: "ENGINEER" will provide additional construction phase services more fully described in Exhibit A. EXHIBIT A, SECTION 3. FEES, PART B. SUMMARY OF FEES shall be modified by the attached Summary of Fees as shown in the attached Exhibit A for an additional fee not to exceed $37,500.00 for a total restated fee not to exceed $308,210.00. All other terms and conditions of the March 26, 2013 contract between the "CITY" and "ENGINEER" and of any amendments to that contract which are not specifically addressed herein shall remain in full force and effect. No. F-1415 Re: Proposal to Provide Construction Administration Services for E12116 Schanen Hike & Bike Trail Phase Ill Project E16258—Amendment No. 3 Dear Marisa Alaniz, Martinez, Guy & Maybik, Inc. (MGM) is pleased to submit this proposal to the City of Corpus Christi Engineering Services Department, to provide construction administration services as an Amendment to the original contract to the Schanen Hike & Bike Trail Phase III Project E12116. PROJECT DESCRIPTION The project shall entail the construction of approximately 1,950 ft of a 10 ft wide concrete hike & bike trail along an existing drainage channel. The trail will consist of 6" thick concrete pavement with an 8" wide header curb on one side. Also included in the construction of the Schanen Hike &Bike Trail Phase III project will consist of site grading, excavation/embankment, lime treated subgrade, timber pedestrian railing, concrete ADA curb ramps, signage, and striping. This project is partially funded by the Texas Department of Transportation. SCOPE OF SERVICES MGM's Scope of Services under this Amendment shall entail the following: CONSTRUCTION PHASE SERVICES 1. Prepare for and Attend Pre-Construction Meeting. (4 hrs) 2. Project Coordination and Construction Documents (20 hrs/month) 3. Assist Client with Change Orders (16 hrs) 4. Weekly/Monthly Site Visits, and Consultant Construction Status Reports (15 hrs/month) 5. Review Submittals/Shop Drawings (8 hrs/month) 6. Address Client's, Owner's, and Contractor's questions/RFI. (8 hrs/month) 7. Assist Client with resolving construction conflicts. (6 hrs/month) 8. Assist Client with Project Close-out, and Final Walk through Inspection. (8 hrs) 9. Prepare for and Attend Project Progress Meetings (As Needed) (3 hrs/meeting) September 11, 2018 1 Schanen Hike & Bike Trail Phase III Project E12116 Corpus Christi, Texas—Amendment No.3 City of Corpus Christi Engineering Services Department EXHIBIT A Page 1 of 4 • Note: The hours provided above are for estimation purposes and base on the original construction duration of the project as specified in the contract documents. SERVICES NOT INCLUDED 1. TxDOT Support/Documentation 2. AD other services not specified under this proposal COMPENSATION MGM proposes to perform the aforementioned Scope of Basic Services on a time and materials basis at the hourly rates specified below for a fee of THIRTY SEVEN THOUSAND FIVE HUNDRED DOLLARS AND NO CENTS USD ($37,500.00). Hourly Rates: 1. Project Manager $135/hour 2. Professional Engineer $135/hour 3. Associate Engineer $110/hour 4. CAD Technician $95/hour 5. Field Technician $85/hour 6. 2-Man Survey $145/hour Additional Services MGM will provide Additional Services as requested by Client or as MGM deemed necessary at a negotiated price or at the hourly rated presented herein this proposal under "Hourly Rates for Addition Services". HOURLY RATES FOR ADDITIONAL SERVICES Any Additional Services performed hourly by MGM and as authorized by the Client, wouldbe charged according to the following rates: Project Manager at$135/hour; Professional Engineer at$135/hour; and Associate Engineer at$110/hour. Note: All hourly rates for additional services are inclusive for overhead costs, including vehicles, mileage, equipment, personal protective equipment, communication devices, printing, etc. SERVICES PERFORM DURING CONSTRUCTION With regards to Windstorm and Construction Inspection Services, MGM shall make visits to the site at intervals appropriate to the various stages of construction as MGM deems necessary in September 11, 2018 2 Schanen Hike & Bike Trail Phase III Project E12116 Corpus Christi,Texas—Amendment No.3 City of Corpus Christi Engineering Services Department EXHIBIT A Page2of4 order to observe as an experienced and qualified design professional the quality of the various aspects of Contractor(s)' work. Based on information obtained during such visits and on such observations, MGM shall aim to determine in general if such work is proceeding in accordance with the Contractor's submittals and manufacturer's requirements. MGM shall not, during such visits or as result of such observations of Contractor(s)' work in progress, supervise, direct or have control over Contractor(s)' work nor shall MGM have authority over or responsibility for the means, methods, techniques, sequences or procedures of construction selected by Contractor(s), for safety precautions and programs incident to the work of Contractor(s) or for any failure of Contractor(s) to comply with Laws, rules, regulations, ordinances, codes or orders applicable to Coritractor(s)furnishing and performing their work. Accordingly, MGM can neither guarantee the performance of the construction contracts by Contractor(s) nor assume responsibilities for Contractor(s)' failure to furnish and perform their work in accordance with TDI windstorm requirements. MGM shall not be responsible for the acts or omissions of any Contractor, or any of subcontractor or supplier, or any of the Contractor(s)'s or subcontractor's or supplier's agents or employees or any other person (except MGM own employees and agents) at the site or otherwise furnishing or performing any of the Contractor(s)' work. MGM will not be responsible for any hidden pre-existing structural conditions or Contractor's work that was accomplished in between the times MGM performed its interval windstorm related construction observations that is not in compliance with TDI windstorm requirements. Any work performed by Contractor that is deemed unacceptable by MGM or TDI shall be removed and/or corrected at Contractor's expense, and not at the expense of MGM. SUBMITTAL REVIEWS MGM shall review and approve (or take other appropriate action in respect of) Shop Drawings, samples and other data which Contractor(s) are required to submit, but only for conformance with the design concept of the Project and compliance with the information given in the Contract Documents. Such reviews and approvals or other action shall not extend to means, methods,techniques, sequences or procedures of construction or to safety precautions and programs incident there to. OTHER MATTERS The obligation to provide further services under the Agreement may be terminated by either party upon seven days'written notice in the event of substantial failure by the other party to perform in accordance with the terms hereof through no fault of the terminating party. This Agreement is to be governed by the law of the principal place of business of MGM.
