Fees shall be amended based on the modified scope of services in the attached Amendment No. 3, Exhibit A for a fee not to exceed $36,800,, for a total restated fee not to exceed $630,230. All other terms and conditions of the May 17, 2016 Contract for Engineering Design Services between the City and Consultant,and of any amendments to that contract.which are not specifically addressed herein shall remain in full force and effect. Director of Engineering Services City of Corpus Christi 1201 Leopard Street Corpus Christi, Texas 78401 Reference: Amendment 3 to Bond 2014 Proposition 2 - Ayers Street— SPID to Gollihar (Project No. E15106) Dear Mr. Edmonds: LAN respectfully requests that the City consider an amendment to our professional services agreement for the Ayers Street Pedestrian and Turn-Lane Improvements Project (E15106). The purpose of this amendment is to increase our compensation for bid and construction phase services based on the exceptional conditions discovered during the design and previous bid phases this project. Additional Construction Phase Services During negotiations for the previous two amendments, budget line items were reallocated in the effort to reduce the overall impact of those amendments. First, in May 2017, prior to the redesign of the project, $36,800 of the construction phase budget was moved to the design phase to compensate for the redesign. This left only a $10,000 budget for construction, which at that time we agreed would be sufficient for this project. Secondly, in May 2017 at the request of the City's Project Manager, during negotiations for Amendment #1, the remaining budget line items for Permitting, Environmental, and Warranty Phase Services were also reallocated to the Design Phase to compensate for the redesign costs. At that time, we had reviewed any potential permitting or environmental issues and mutually agreed that those services were not going to be necessary for the future of the project. Lastly, in November 2017, LAN requested additional fee (Amendment #2) for added coordination with the SUE firm and redesign of water utilities to avoid conflict discovered by the SUE investigation. During negotiations for this amendment, it was agreed to reallocate $4,100 from the bid phase budget for these additional services. These reallocations are included in Amendment #3 and summarized in the table below. Previous Bid Phase Services Performed As mentioned above, LAN's original engineering design contract included $12,100 for bid phase services. In November 2017, as part of Amendment #2, $4,100 of that budget was moved to the design phase to compensate for those services. On February 6th, 2018 LAN delivered a final Issued AMEND. LAN completed bid phase services up until the point the project was cancelled in April 2018. During that time, LAN spent and invoiced for the remaining bid phase budget, $8,000.00 and the remaining construction phase budget of $10,000, leaving no additional budget for future bid or construction phase services. Scope of Amendment #3 —Additional Bid &Construction Phase Services As mentioned above, LAN's original engineering design contract included $46,800 for construction phase services. In May 2017, prior to the redesign of the project, $36,800 of that budget was moved to the design phase to compensate for the redesign. Also mentioned above, a portion of the bid phase services were reallocated, and a portion of those services were performed during the first time this project was issued for bid. During the finalization of the design and the first bid phase of the project it was discovered that several exceptional conditions existed on this project that may require additional construction phase services. These services were not anticipated at the beginning of the contract nor in May 2017 at the redesign meeting. These exceptional conditions will result in more time for LAN employees to answer City and Contractor questions, visit the construction site, develop possible RFP's, field change orders, clarifications, etc. These exceptional conditions include: • Combination of full depth widening of the street and mill &overlay to repair the center of the street could cause contractor questions and concerns during bid and construction that would require LAN to answer. • Differentiating cross slopes across the entire project will require varied mill &overlay and pavement level-up in some sections of the pavement. There is no typical cross section along the length of this project. • Unforeseen conditions(depth, quantity, etc.)with the existing buried concrete pavement in the center of the street which may conflict with the mill &overlay. • Coordination with the sub-contractor(s) for the installation of the proposed water line infrastructure including sequencing, construction means & methods, etc. • Additional contractor submittals to review for utilities infrastructure revisions unforeseen at the beginning of the project. • Coordination with the City and Contractor during the installation of the drainage systems and inlets along the right-of-way to ensure they meet the overall intent of the project. • Coordination with the City and Contractor during the installation of the water and wastewater utilities to assist with possible conflicts unforeseen during design due to the limited SUE investigation performed. Summary LAN understands that this project is unique and has promised to deliver a project that is both complete and constructible. For that reason, we anticipate that we will require more fee to complete bid and construction phase services. AMEND.
