Palm Land Investment, Inc. ("Grantor"), whose address 5949 La Costa Drive, Corpus
Christi, Texas 78414, for and in consideration of the sum of One and No/100 Dollar
($1.00) paid by the City of Corpus Christi, a Texas home-rule municipal corporation
("Grantee"), whose address is 1201 Leopard Street, Corpus Christi, Texas, 78401, the
receipt of which is acknowledged, has granted, sold and conveyed and by these
presents does grant, sell and convey to the Grantee, its successors, legal
representatives, permitted assigns and franchisees, the free and uninterrupted use,
liberty, privilege, and easement, of going in, on, over, under, and along a certain tract of
land situated in Nueces County, Texas and being described as follows:
Field note description of a Temporary Right-of-way over and across a
portion of Lots 4 and 5, Section 27, Flour Bluff and Encinal Farm and
Garden Tracts, as described in Document Number 2013020672 of the
Deed Records of Nueces County, Texas, which descriptions are attached
to and incorporated in this document as "Exhibit A", and depicted on the
field notes location maps attached to and incorporated in this document as
"Exhibit B", the exhibits collectively being referred to and known as the
"Premises."
Together with the free ingress, egress, and regress to and for the Grantee, Texas, and
its franchisees, to erect, construct, install, lay, replace, service, use, operate, inspect,
reconstruct, modify, remove, repair, operate, keep and maintain streets, sidewalks,
curbs, gutters and appurtenances upon said Premises for the public use by foot, with
automobiles, carts, carriages and all other vehicles and all other means of
transportation necessary or convenient at all times and in all seasons in, along and
upon said Premises, as well as for the purpose of erecting, constructing, installing,
laying, replacing, servicing, repairing, using, maintaining, inspecting, reconstructing,
modifying, removing, operating and keeping utility lines in, over, under, on and along the
premises, including but not limited to water, wastewater, storm water, storm water
detention, filtration, drainage and gas, together with all lines, pipes, conduits and other
equipment, improvements and appurtenances used in the supply and provision of public
utilities.

INDEXED
TO HAVE AND TO HOLD, all and singular, the rights and privileges as described above
to the Grantee, its successors, legal representatives, permitted assigns, and
franchisees, for the proper and public use as a temporary right-of-way and for so long
as used for such purposes and, if the use of said temporary right-of-way be ever
abandoned, then, in that event, the aforesaid rights and privileges shall cease.

the Grantor, represents, warrants, and guarantees that they are the Grantor or have the
authority to act on behalf of the Grantor for the purpose and consideration stated.

LEGAL DESCRIPTION
14,400 SQUARE FEET/0.33 ACRE
BEING a 14,400 square foot or 0.33 acre tract out of the remainder of a 55.26 acre tract
described in Document Number 2013020672 of the Deed Records of Nueces County, Texas, and
being more particularly described as follows:
COMMENCING at a 5/8" iron rod found with red plastic cap stamped "NAISMITH ENG.,
C.C., TX"marking the Southeast corner of Block 10, Lot 7 of the Amending Plat of Sandy
Creek Unit 1 as recorded in Volume 68, Pages 570—571 of the Map Records of Nueces County,
Texas. Said iron rod also marking the Northwest corner of Block 10, Lot 24 of Sandy Creek
Unit 2 (not yet recorded);
THENCE South 28°36'24" West, with the west line of said Block 10, Lot 24 of Sandy Creek
Unit 2, a distance of 110.00 feet to a 5/8" iron rod found with red plastic cap stamped
